  Hey Uniden - so good to hear of your passport request! I do check this website off and on and have been wondering about the decision on your case. Congratulations and all the best. It is brave to arrive here in Dec - we did the same last year and went through the extreme winter. Anyways, the good thing is that it can only get better after that. And weather is just a small factor in the whole picture. I´m sure you will settle down well here, just like us and a lot of members here in this forum.

Uniden, nice to hear from you again. I rarely join in this forum, yet, there are lots of valuable advices and insights when my partner and I started the process of FSW. We received our visa 3 months ago and pretty soon will land in Toronto by the end of August.
Like you, I also was out of status for 7 years in the States. Plus, we applied as SAME-SEX/common-law category. So indeed, to those who are in the same situation as mine, it is possible to get your visa to Canada.
Patience always pays off.

Just curious; is Uniden out of status in the us for the last 7 years? Then how can he continue work there without any legal status? In his last post he mentioned that he even would continue his US job after landing in Canada.

Good to hear from you, and that you´re doing good in Canada! :) I still remember the issues you had with your son´s education when you received your PPR.. It is probably all forgotten by now.. Best wishes to you and family!

I did not say that I was illegal for 7 years. I was illegal for probably almost twice that long.. As for working in the US illegally, and how this is/was possible, I can only say "Where there´s a will, there´s a way!". FYI, working for my current US employer after I land as a Canadian PR will NOT be illegal any more. I will be able to LEGALLY work on a contract basis, or even be put on the payroll. It is a good way to bridge the time between landing and finding a job in Canada.

I am puzzled at how Uniden´s application was processed in the U.S whilst he was out of status in that country. I know of many people who were asked by Buffalo to return to their home country for an interview and all were refused their visas. Can someone shed some more information on this matter because there are thousands of people in the states who would like to do what Uniden did.

If you were admitted to US with a valid visa of 1 year or more duration then you can apply for Canadian PR at Buffalo even after going out of status. In case your initial entry was not for one year but subsequently you were granted some sort of status (H1B, Student, Adjustment of Status) which was of more than one year duration then again you can apply through Buffalo.

It would probably be very helpful to read CIC´s OP1 Manual:

Despite what is being said in Section 5.23., Section 5.17. lays out what "lawfully admitted" means. Of special interest to you should be Section 5.17.2.i. (I have underlined the fragment that applied to my case):

"For the purposes of R11, situations in which an individual is considered to have been ?lawfully admitted? will include (but are not limited to):
i) persons who were lawfully admitted, but no longer have legal status when the application is submitted. For example, a person who has entered a country lawfully but at some time subsequent to lawful admission has lost legal immigration status is considered to have been lawfully admitted, whether or not status has been restored at the time of the application to the visa office. Such applicants may or may not qualify for a visa, but their application must be accepted for processing and assessed on its merits."

My sincere congratulations to you Uniden, on getting your passport request.

After 14-15 years of out of status, it must feel very good to finally be the legal path.

I am waiting for a similar outcome for myself and hopefully I will know by next week.
