Subject: Citizenship and removal order
 

In 2001 I was in Canada under a visitor´s permit living with my wife who is a Canadian citizen.
I applied for an extention which CIC took over 3 months to processed (of course my status expired due to lenght of time). I was called in for an interview and CIC refused my extention and I was given a "Volunteer departure order".

I followed CIC´s instructionS as per the law and 20 days later I left Canada with my wife.

Two years later I applied for my PR status as a family member from abroad and with no complications my PR was approved and my wife and I moved to Canada for good.
I have been living here for over 2 years and pretty soon I will be able to apply for citizenship.

I was reading the application today and my question is:
There is a line in setion 8 that asks if I have ever been under a removal order.

I assume that I have to say YES but is that going to affect my application for citizenship?

I remember explaining the volunteer departure order in my PR application (in a letter) but I also clicked saying that I have never been asked to leave Canada when I applied for my PR.

explain it, and that is all you can do. It will flag on your passport anyway so you may as well be up front about it.

I have exact same issue and I have discussed it with lawyers and Immig officials. Its just a formality. you must declare what is asked. They want to make sure you did not commit war crimes and have come back again to Canada.

No Worries as long as you "leave Canada" command did not in any way associated with criminality. So many people overstay their visitor´s visa. It all depends on what account you were asked to leave Canada.

Hi,

I know that this thread ended years ago but I stumbled upon it while searching the internet for answers to my dilemma. My situation is quite similar except for a few differing details.

First a brief history: In May 2008 I applied to extend my TWP but was denied on the grounds that I had previously withdrawn an application under another immigration category (I´m still unsure if this was really the case)... anyway, my TWP still had a few days left on it so I rushed to make another TWP application to "buy" me time, that is, so that I could be under "implied status". A few weeks later I found out that my TWP application had been transferred to an immigration center near my location. After much reflection and after my employer offered to sponsor me under the Nova Scotia Provincial Nominee Programme, I decided to return to my home country before any decision had been made on my TWP renewal application. Before I left, I made every effort to inform CIC and the Canadian Immigration Center about my decision to leave Canada: I called them, faxed them and typed a letter which I dropped off, in person, at the Center. When I got back home, I applied for PR through PNP and waited. In the mean time, I learned that CIC had gone ahead and issued a DEPARTURE ORDER in my absence: :-O I asked a friend to send me the order and I quickly wrote a letter to the Canadian High Commmission in my country explaining the situation (that is, why I didn´t inform an immigration official at a port of exit). I attached the DEPARTURE ORDER to my letter and a copy of the fax I had sent to CIC while I was in Canada informing them of my departure. Months went by and after nine months I was granted Permanent Residence! I landed in January 2010 without any problems.

Now my dilemma: I was so eager to know about the next step in becoming a Canadian citizen that I began to look into the application process. To my dismay I discovered that if you are under a "removal Order" then you are ineligible for citizenship!! I don´t know if my DEPARTURE ORDER became a deportation order when I didn´t confirm my departure with a CBSA officer at a port of exit. An ARC (authority to return to Canada) was never asked for. When I do eventually make my Citizenship application, will I have to check "yes" where it asks if I was ever under a removal order???
