Subject: Visitor Visa Extension
  My mother came to Canada on visitor visa, i applied for an extension on June 25, 07 and so far there is no reply from them. Her visa has expired on August 13, 07 and we are still waiting for a reply .
I wonder does it take this long for an extension?
What should i do if she does not get an extension because i want her to stay for few more months?
What is her current status when her visa has expired and our extension application is still in process?

Help me plaese and thanks in advance.

CIC tells us to apply 30 days in advance to extend a VISA so you have likely jammed your timing. However, the CIC website suggests that you are eligible to stay until you hear from CIC.

If she does not get her extension she is technically obligated to leave Canada immediately. Failure to do so makes her ´out of status´ and open to being disallowed from coming back at another time.

Not only that, (I realize that you probably don´t care about this part) but she becomes another statistic that validated the tougher and tougher criteria for visitor visas.

Sharon, i applied on July 25, 07 well before the expiry of visa around 45 days before the expirt so i met their requirement (CIC). She will leave the country if she does not get an extension because i am the kind of person who does not go aganist the law but i have to wait for their reply. There is a clause of re-instatement of staus as well if she goes out of stsus, i just came to know that if she goes out of status i can apply for re-instatement as well. Anyhow that is a different story. thanks for the response by the way.

Malik,

Here is what happens....
CIC sometimes takes longer to process visitor extentions. However she may stay in Canada until an officer makes a decision and as a matter of fact I would strongly suggest NOT to leave Canada until you hear back from CIC. At this point in time, she will get one of two things:

1- An approved extention
2- Be called in for an interview.

When she is called in for an interview, the officer will ask the reason of the extention and if he/she denies it, your mom will be given a "Volunteer departure order" since her permit already expired.

The Volunteer departure order is a document that if she leaves Canada within 30 days after getting it, she will NOT have any problems when returining to Canada in the future other than the normal procedure.
If she doesn´t leave Canada though, after 30 days becomes a deportation order and then things can go south pretty quick.

I´ve just been through the same process and can confirm that there are long delays at the moment due to the high number of applicants over the summer period so don´t be too concerned. In fact the CIC website states that it is currently taking 87 days to process these extensions and they are only up to May 21 at this time. So July 25 plus at least 87 days will give you an idea of when to expect a response. Also, when I called to check on my extension I was told that it is rare to receive a rejection unless there is a major issue so if you´ve filled out all the forms correctly etc I don´t think you need to worry.

Hi sorry to butt in! Thanks for the clear info... can someone tell me what the fee is for applying for a temporary visa extension. Or perhaps you can tell me where to find it, im having trouble finding that info.

Extension of stay is 75 dollars and you can pay online and print the reciept. below is the link as well on CIC website where all you can find all the information including the fee!

Hi there,
I have the same problem with Malik.
We forwarded our extension visa last february and my visa will expired on April 26, 2008.
Is it possible to get my visa before the expiration date of my visa?
