  hello! if anyone could help that would be grrrrrrrrrrreat!!!!!!
our situation is a bit complex, as all international relationships are i guess!
i am canadian and my husband is spanish. we were married last year in ontario, but we decided to live in spain. now we found out that we are expecting our first child, and would like to move back to canada to have the baby and raise it there.
i have been researching on what we will have to do for my husband to be able to live and work and canada, but i am sooo confused! i understand that i will have to sponsor him, buttt, i haven?t lived in canada for over 2 years, therefore i obviously do not have a yearly income of over 20,000! my parents have said that they will sponsor him, but i?m not reading anywhere that that will be possible! pleaseeeeee, if anyone knows what we will have to do in this situation!
obviously we do not want to be separated as we are expecting our child, and i wouldn?t even be able to get a full time job right now! also, if someone could please explain to me what exactly happens during this sponsorship. when will he be able to work? will people really come and ask us personal questions? i don?t get it! it?s all so confusing! and to make matters worse, i?m an emotional pregnant wreck! ahhhh lol.
so yeah, please please please, anyone who can even slightly help, your advice/knowledge will be deeply appreciated!

Intersting case, not sure about you.

But in any case, sorry to say, spousal immigration process will take at least 1 year (varies from country to country). So, most probably your husband will be late to hug the new born at the correct time.

Your parents CANNOT sponsor him, you have to sponsor him. Usually, spousal sponsorship is very straight forward, just a matter of time.

Most of the provinces, spousal sponsorship doesn´t need any min´m income. However, your case may be little complicated as you are outside of Canada. Canadian citizens can sponsor from abroad, but I´m not sure how it will be processed. Did you pay taxes regularly for the years you were out? it may be important. You have to select a province to stay upon your husband´s arrival in Canada. See page 15 in:

if you are a PR, you are not eligible to undertake an out of Canada sponsorship (where both of you are outside Canada) You would need to return to Canada and proceed from here. There is a chance CIC would allow your husband to join you but the odds are not good. He would need to come as a visitor and would not be eligible to work until you have an initial approval from CIC (at which point he would be able to request an open work permit). If he is able to get into Canada and live with you during that application process, it will be done through Buffalo. The wait is well over a year, start to finish.

Proof of income is not a requirement in the case of spousal sponsorship.

If you are a citizen, and you are applying from Spain, you will need to show CIC that everything is in the works for you to return to Canada.

timing for all of this is very much dependent on which route you take. If you remain in Spain, I believe you must go through the embassy in Paris. Once CIC in Canada approves you (as the Canadian) everything switches to your non-canadian spouse and his eligibility. In Paris that is 5-9 months.

Where YOU start the process is the big time variation.

Sharon,

She didn´t say that she is a PR. In my understanding she is a Canadian citizen.

You may sponsor your husband from abroad, actually is faster to do so from spain.

You don´t need to meet an income requirement in your category.
You are going to have to probe that your relationship is genuine with some supporting documentation. (Pictures etc.).

Process is very straight forward and it might take around 8 months. You may stay with your husband until the process is done or you may go to Canada first and your husband may arrive later once his permanent residence is approved.

That?s correct Bill, I am Canadian. Thank you all for your help, I now at least have my head around it a bit more. Don?t mean to be a pest but I now have some new questions :-)
Unfortunatly we don?t have time to be able to go through the process from spain, with me being pregnant and all. And obviously we want my husband to be in Canada with me for the birth.
What will happen if my husband flys back with me? Can we start all the paperwork while he is here as a tourist? Will he have to leave after 3 months? Could we just go to the states for a night or so?
One thing I would like to mention as well. 2 years ago he did live/work in Canada (my dad was able to get him a permit), would that speed up the process at all? probably not eh? and say, if my dad could get him a permit again, would he be able to work on that permit and go through the sponsorship process at the same time?
Also, that?s great that I don?t have to meet an income requirement! But if someone could tell me what the requirements are, and why some applications are denied?!

Yes, he may apply for a work permit (outside of Canada) and once he is in the country he may apply for a permanent residence status from within Canada as a family member.

The little tricky part here is this:
As per the law a work permit is a document to work ON TEMPORARY basis in Canada. If an Immigration officer gets the impression that he wants to stay in Canada for good more likely the visa will be refused. Make sure that he can probe that is intentions are not to stay in Canada (even if that changes in the future).

2- You may sponsor your husband within Canada, the process usually takes longer than applying from outside.
After a year (roughly) if he gets what CIC calls ´Approved in principle" he may be able to apply for an open work permit (means he can work anywhere in Canada while his PR is in process). That is if enters Canada as a turist.

The downside of applying from within Canada is that if your application is rejected you have no right to appeal the officer´s decision.

Some applications are refuse for insuficient probe that is a genuine relationship. It is in your own interest and responsability to convince the Immigration officer (with pictures, cards, phone bills etc) that you are in a genuine marriage.

He can be rejected under grounds of security (previous or pending convictions) if applies or due to health problems.

I am probably missing couple more things but I cannot remember at this point.
