Subject: Six Month Stay
  I am a British Citizen and my son has sponsored me to move to Canada. As I have no other family in the UK I have been living with him in Canada for a while.

As a British Citizen I do not need a visitor visa to enter Canada provided my stay is less than six months. I initially came here in December 2006, then I returned to the UK to stay with friends for three weeks in May 2007, ie before the six months were up. I have been back in Canada since May 2007 and my six months will be coming up again in October 2007.

My question is, can I cross the land border and spend a night or two in the USA and will this then be counted as an end to my stay in Canada, ie before the six months are up? Then can I return to Canada, across the land border, for a further six month period?

Will an overnight stay in the USA suffice as a break in my stay in Canada? Do I need to stay in the USA longer? Will two nights be better?

Any help and guidance would be very much appreciated.

even if u leave canada for 1 minute ur stay is ended so u need not worry, 1 day is fine in usa

just be aware that re-entry is not an iron clad guarantee. You still need to show purpose to your visit and verification that you plan to return home at the end of your visa term.

I don´t know about anything specific about British Citizens, but in general if you are applied for immigration then till that case is finalized you may be rejected to enter in other categoris such as student..tourist.

That´s why in the application visa form (for most other countries)there is a declaration needed for that.

Does it mean that if I had applied for Canadian Immigration from US, I cannot apply for Canadian work permit?

Canadaman,

You can apply for work permit even though your PR application is in process. There is no automatic denial for cases like yours. However, you will need to convince the IO that you will return in case your work permit expires and you have not received the PR.

Jjuk,

Every time you enter Canada you have to state the purpose of your visit. If the officer realizes that you are actually residing in Canada instead of visiting, he may refuse you from entering.

I´m not sure about the work permit, already clarified by Samm.

But if you are in the process of immigration then you MAY be denied for any other visa categories. This holds true for also US. That doesn´t mean that you´ll be denied for sure. But there is a good chance, upto the Visa issuing officers consideration.

For this particular case, I would suggest not to disclose the immigration application matter if not asked, but if asked specifically he must have to say. He should just approach as a regular tourist.

When my application for immigration in process, I got hired by a Canadian company, got a work permit and arrived here and in a few more months got the PR too. When applying for workpermit from outside Canada, you need to inform the embassy that you have PR application in process. They never queried me further (whether I will return or this or that.... but I did have an interview with some official at the Canadian embassy).

Come on guys, you have started some other discussion. The ANSWER TO YOUR QUESTION IS YES, ONE DAY IS GOOD. AS LONG AS YOU ARE OUT OF THE COUNTRY YOU ARE GOOD. SO IT DOES NOT MATTER HOW MANY DAYS OR HOURS. SO GOOD LUCK!

the question asked by jjuk is if he can reenter canada after 1 day. so we have answered him the question, i assume he will be well prepared while entering, we are not entry clearance officers to judge on his entry or not.
