Subject: sponsoring spouse..questions
  Hi all I need your help, I have few questions regarding sponsoring spouse.. Please advice.

1) I wanna sponsor my spouse who is in US. Now question is if I apply in CPC-M (Missisauga) then CPC-M will send the file to India (spouse origin coutry) or to Buffalo. If in India then how it will work.. since spouse is in US and file process is in India. Please advice.

2) During processing of immigration, which seems tobe 4 months affaire, can spouse come to Canada on visitor visa?? Is it possible? How long visa is issued.

Please advice.

I strongly recomend that you apply for your wife´s immigration from India. Surprisingly it is a lot faster than Buffalo for spouse sponsorship. You can check the average processing times from the CIC website. From India its 2 months on an average.

BUT if your spouse applies from India she will have to go back to India if and when called for an interview or when passport request comes.

You can try to apply for visitor visa for your spouse but it will definately be rejected as they know that she is applying for PR.

Can i request CIC to process file in buffalo instead of New Delhi? Since spouse is in States? Her mailing address would be in states.

If you husband has a green card then he can come to Canada and stay up to six months as a visitor. If he applies for visa after your application, he might be rejected. If he is in States longer then a year, then you have an option to choose when you want the application to be processed. It is really up to you.

Hi Veer,

Spouse sponsorship processing time:
New Delhi - 2 to 4 months
Buffalo, USA - 9 to 19 months

Make your choice!

You can only sponsor your spouse from USA if s/he has been admitted in USA from more than one year i.e. her visa validity when s/he was granted visa was more than 1 year.

You can try to apply for visitor visa but it will most probably be REJECTED!

One of the main things to consider when deciding where to have a spousal sponsorship application processed is: If your spouse requires an interview will they be able to get to the interview location. For example, if your wife´s application is processed by the Case Processing Centre in India and she requires and interview, she´ll have to go to India in order to attend the interview; if her application is processed by Buffalo her interview would be in the U.S.

Of course this is assuming that your wife has been legally admitted to the United States for over one year. If she hasn´t been legally admitted to the U.S for atleast one year, her application must be processed by the country of her nationality (that being India in her case).

So while the processing times are quicker in India, you should take into consideration whether or not your wife would be allowed back to the U.S without a problem should she need to leave the country for an interview.

Spousal visa...HELP! (in reply to: sponsoring spouse..questions)
Hi all.

My fiance is Brazilian with dual German citizenship. We are getting married in September. I am wondering what I should do re. getting him a spousal visa. Should I:

1: Start the process now and apply to sponsor him as my conjugal spouse and then update the application after we are married. My additional question here is: He will not come to Canada until a couple of weeks before the wedding...as a German citizen, he hasn´t needed a visa in the past to come here as a visitor but will he be denied entry if we start the application process before he gets here?

2: Wait until he is here (as a visitor) and we are married before we start the application process.

3: Get him enrolled in a course so that he can come over as a student and apply separately for the spousal visa (so that a) we can start the process now so that he can get residency faster and subsequently start working sooner and b) so that we don´t have to be apart during the processing period.

We really want to be together here in Canada after our wedding. What is the best way to do this while applying for the spousal residency? Also, can I start the application while he is not here and still be able to have him come over here? Even if it is as a tourist...

I am really frustrated over this whole procedure...can anyone help me? How, if possible, do people get around this?

IF i go in a visitors visa to canada, and then apply there..ow long would that take?

hi,

i have been trying to sponsor my wife since feb 2005. the office processing her visa is London, UK.
they requested that she repeats her medical exam end of august 2005 because the first one expired (yes started the sponsorship application in aug 2004)
After some inquiries, it turned out that her immigration file is under security checking.
1- does anybody know how long it takes for security checks to be complete in the case of sponsoring spouses?
2- what are the next steps before she immigrates?
