Subject: canadian marrying out of status in US boyfriend
  hello there:

i am a canadian and am engaged to my boyfriend who is out of status in the US. we are planning on getting him sponsored after we get married. i have a few questions:

1. will our marriage in the US be acceptable?
2. can he stay in the US during the application process?
3. do all the required documents need to be filed after marriage? ie. FBI clearance and medical exam?

My experience showed:
1. the marriage in the US will be acceptable
2. Since he is out of status in the U.S, he has to return to his home country for interviews etc.
3. All documents need to be filed at date of application.
I would appreciate other views on item 2 as this is only my experience.

As I learned from celebrity Uniden case from here; illegal residents of US shouldn´t have problem IF he entered into the USA legally.

he is already staying in the US illegally, so no question of "Can he stay in the USA during the process". Canadian immigration can´t request US immigration to grant him legal status. Simple.
