Subject: Stay of Removal
  Had a SUPER day today all.

I got a stay of Removal for my client who was scheduled to be removed September 25th 2007.

This is the second time in a couple of months I got a deferral or stay of removal. The first case was Hong ZHANG unwed mother. Today was a Portuguese Construction Manager. Getting Removal cancelled when a flight is already booked is a huge thing.

My client had been wrongly accused and labelled. Even though he has a common law spouse and a Canadian child those things never entered into the Removal Officers decision when he tried to force him out of the country.

CIC & CBSA officers do not always play fairly. Just because they say it is so, does not mean it is correct!

I tell all here to read the CIC Manuals which clearly explain what the officers should and should not do in certain circumstances. Or better what they must do and should not do in certain situations.

I found a situation that could really turn things around for my client and shoved him through the door. Now his wife who has limited education will be able to feed her family this fall and winter. Then by spring I expect her husband to have legal status in Canada.

Stay´s of Removals are extremely rare and are normally issued because of Federal Court Decisions. Going to the Federal Court is the only thing a Consultant can´t do when it comes to Immigration.

THIS TIME THE STAY WAS ISSUED BECAUSE WE WERE CLEARLY RIGHT.

Congratulations Roy! You hit the point that I was saying all along, some CIC officers are not fair and not everything they said is gospel truth. I was successful in getting a retarded girl, 21 years old who was refused her PR visa and could not travel with the rest of the family who were sponsored. She was mentally retarded and the visa officer in Port of Spain refused her visa as he said she will be a burden to the health systems etc. I submitted arguments quoting two case laws, medical opinions from specialists doctors and the girl will be in Canada in the next few weeks.My message is this, if you think you have been rejected wrongfully, you can still fight the system legally and win. The system is fair except as I always said, some visa officers are rough.

i got a removal letter and i am married even before i got it but i have not sent my pappers in an i lucky to have a removal stay plase tell me what can i do
