Nigel Cruickshank is no angel, but he may be Canada´s problem, not Trinidad´s.
The 34-year-old is being deported to Trinidad ? for the second time ? next Tuesday.
Problem is: he´s a Canadian citizen. Or at least that´s what he and his lawyer believe.
"Based on the information I have (it) appears to be an administrative oversight that Nigel´s citizenship was not granted," lawyer Mary Lam said.
"If that in fact is the case, you cannot deport Canadian citizens."
Cruickshank immigrated to Toronto as a toddler in 1975. Three years later, his mother applied to become a Canadian citizen and on the advice of an immigration official, included the names of her three children, two of whom were born in Toronto.
"The guy who helped me fill out the form down at the Dufferin and Bloor office told me automatically Nigel will become a citizen the day I become a citizen, because he´s under age," said Merle Akinmusire, 62.
So when Akinmusire received her documents that July, Cruickshank said he never thought about it again. That is until 1995, when he was deported to a country of which he had no memory.
"I´ve maintained I am Canadian from the get-go." Cruickshank said from the Metro West Detention centre. He has been denied bail three times because he´s been deemed a flight risk. Lam, Cruickshank´s lawyer, filed an access to information request last month for his file. She hopes it will show why the citizenship was not granted. From there, Lam will appeal to the federal court to stay the deportation order.
But time is running short.
"Immigration knows the papers are there, just no one chooses to look ... This is my right as a Canadian, to have someone look behind a computer screen. I feel like I´m being violated. Yes, I´ve had trouble with the law, but I´ve cleaned up. But as a Canadian citizen I shouldn´t be going through this," said Cruickshank, who has one child and three unofficially adopted children.
Cruickshank´s trouble began in 1993 when he was arrested and served time after committing a series of various offences; assault, break-and-enters, car theft and possession of weapons.
It was at this time he learned that despite the fact he had a social insurance number, Ontario driver´s licence, health card, and filed his annual taxes, the proper citizenship documents never went through and there was no record of him being a citizen, he said.
Cruickshank arrived in Trinidad with no contacts or close family, and stayed in a hotel for 10 days while he applied for a Trinidadian passport.
After that, he bought a ticket back to Toronto, where he continued to work and pay taxes for more than a decade.
During this time, Cruickshank stayed out of trouble and gained a management position at a Thornhill auto parts company. But in 2005, he got caught fighting and was charged with assault.
Although that´s not why he´s currently being deported. He was picked up as an illegal alien on a routine check this past summer and has been in jail since the end of June.
An immigration spokesperson reviewed Cruickshank´s file and referred us to the border agency. A spokesperson for the Canada Border Services Agency was not able to comment on the case.

Your legal counsel leaves plenty to be desired.
The FOSS notes would show everything and are availble free of cost. You could of obtained your complete file FREE OF COST but whom represented you did not choose to research your situation properly.
I always say that hire a knowledgable person who has experience in your area of concern and get references from his/her former clients.
The law is the law and it does not matter what you weigh, colour of hair, eyes or anything else.
You had an obligation to behave yourself and to ascertain your legal status.

Nigel, get an immigration lawyer of your choice. Read, inquire about the lawyers, their success stories and knowledge and hire one of them. Good luck.
If you are concerned about your race as your brother here is, then hire ROY! He is white and will be able to help you better than a black lawyer... LOL!!

I do understan where you are coming from however the FOSS file doesn´t have this information, as if it did I would have not been deported the first time. My situation is complex, meaning that when my mother applied for me citizenship in 1978 i was automatically granted citizenship as per the act of that time. Now I am in possession of the original application for citizenship and my name is listed as her dependent also my two younger siblings are listed but they are list with birth place of canada, so perhaps it was a clerical error on their part or they had other things on their mind like the changing of the act in february of 1977 and so on. When you say my obligation to behave my self and ascertain my legal status.
Roy I was 2 when i came here in 1975 and i was 5 when i automatically recvd citizenship in 1978, so to ascertain my legal status, I am canadian its all i know why would i think anything else, i didnt even travel. Many people have thought they were canadian who were born here just to find out that because their parentmove elsewhere they lost the citizen status. They are now just only fixing that. So my legal right as a canadian citizen have been violated on numerous levels. I have an obligation to behave myself is correct just as any othe canadian citizen does, howeverwhen a canadian citizen which i am doesnt behave theirself and becomes entangled in the justice system just as i did(I am very ashamed of this) they are either found guilty or not guilty. If found guilty they are given a sentence of some sort and once that sentence is completed they basically have paid their debt to society. I have don this and for the most part have been oout of trouble for about a decade. I now wonder why then since I have stated that I am a citizen then why do they chose only to look on the computer screen and not get down to business with my case? I recvd the originalapplication from citizenship canada, if they were hiding the fact about my status would they not have sent it to me..

Understand that a Citizenship check is a simple process that they do every time they try to remove a PR which they have done to you.
They found no record and removed you yet you claim you were granted citizenship. Were us your Citizenship card?

wrongly deported (in reply to: WRONGLY DEPORTED) i had no hearing, i don´t know why i was deported, i received information from foia, it wasn´t any help. i would just like to know what to do its been 3 years,i am very ill and lost my benefits from social security
