Subject: Health Issue not Money Issue
  To All

Finally the Canadian courts rulled that common sense prevails. It is not how much money you have but whether or not you are able and willing to take care of a family member.

Prior to this money was the main issue for medical inadmissability. Prior to this ruling only business applicants could get around having a dependent who was medically inadmissable now it affects all applicants including SW.

A decision with compassion and common sense, it seems to me as well.

Interesting that the ruling mentions "willingness to contribute to future costs" of the family member´s medical condition as a caveat for allowing the application. This implies a conditional step-back from the universality of Canada´s health care system, in certain immigration cases. However, I´m sure the family would be pleased to accept such conditions to attain immigration status.

The Universality of Canada´s healthcare does not imply blanket coverage for everything and anything. I know some Canadian families that have fallen on hard times with unexpected disease and no supplemental insurance to fall back on. For example, retinal degeneration treatment with a specialized medicine (costs 2000$ an injection) is covered fully only in Newfie and New Brunswick. One guy I know tried to create false records and was penalized by courts. Anyways, there are many acquired medical conditions (blood cancer etc) that are not fully covered. Expenses can be a few hundred dollars a year to tens of thousands.

Lets bring this comment back to normal situation.

Too many Canadians are Diabetics like me yet that disease would make any family inadmissable. Even if it is adult onset diabeties.

The costs of most medications could easily be covered by any family that are employed but the SW would be found to be inadmissable.

Does this mean that a SW PR or a citizen who wishes to sponsor his/her parents will not be able to do this anymore if one or both the parents is/are diabetic or has hypertension?

other way around Newbie. What was an automatic disqualification will now be offset against a family´s ability and willingness to take care of that family members needs.

The ruling is specific to the inadmissability of a skilled worker who has a partner with health concerns. It is unclear in Roy´s post how this will affect family sponsorship applications.

The decison refers to family members aka dependents and not only family members of Investor class persons
