1.Received passport request from Buffalo. Their letter says to send original VALID passport. I have my current valid passport and a previous expired one.Do I need to send both to them or just the current valid one? please advise asap.
2.My expired passport has US VISA stamp when I originally arrived in US 3 yrs back. I am in legal status with I-94 is still valid unti next year. Do I need to send expired passport with I-94 copy as well to CIC, just to prove I´m in legal status in US? They didn´t ask for it.
3. Should I really be clarifying this with CIC Buffalo? I emailed them query, but haven´t got response yet. And their phone # (716) 858-9501 plays prerecorded message only; can´t get somebody on the phone.
Please reply asap. Your suggestion/help is sincerely appreciated.

I am in the same situation (though still waiting for PPR)
SEND BOTH !!!
They will stamp the valid passport. You have nothing to lose in sending both. In fact in my case, my country embassy stapled my old and new passport together so I don´t have a choice.
I would strongly recommend you to send both so they can see your legal status in US.
Also follow Uniden trick and send with your package a prepaid Fedex return envelope for fast processing.
Then TELL US IF IT WORKED. Uniden got his passport after 2 days!!!
By the way when did you complete your medicals ? Are you dealing with Buffalo office from US ?

Canada government does no care if one has legal stsus in the US or not!!
You may send either both or your new one.
BTW when you filled the Canada immigration form, which passport number did you write? If it was the old one, then you must send both.

I have the similar case, I sent both of my passports by stapling them together while applying for Australian visa in Mar 2004 , did it again in June 2004 for Australian work permit, and again in 2006 for US work permit. I was so instructed by my company´s American Express helpdesk.Never faced any issue and got visa all the times.
In my opinion you shoild send both of them by stapling them together.

You see, Ninja, it is better to send both.
Canada may not care for your status but to be on the safe side it is good to send both.
Almost Perfect!! is right, you don´t want a mismatch with what you wrote on your immigration form.

I got my PPR from Detroit and their instructions was that you should remove all attached expired passport and only send the valid one.
I am not sure about Buffalo.

Didn´t realize your passport situation was so complicated. I need to change my answer to "both". If your application has your old passport number, you need to send that one. But you must send your current passport. CIC needs a valid passport for your visa.

His/her passport is not complicated. We are in the same case and many people went through the same thing.
There is a time when you have to renew your passport so you end up with 2 passports for a while. It is obvious to me that if the initial forms had the old passport information then you should send both unless instructed otherwise.
We plan to send both of our passports whenever requested.
