Subject: urgent & critical situation: your advices please!!
  Hello board

Allow me to introduce myself,

My name is Stephanie and I landed in Canada a little over a year ago (august 24th 2006) on a work permit (1 year work/visitor permit delivered in France, my country of citizenship)

In febuary I was hired as a bilingual coach/supervisor in a big call center in Halifax Nova Scotia. Around May they informed me they wanted to keep me so we went ahead and put a solid file together that we sent to the HRSDC. My job included outstanding reports on my performance as a coach/supervisor with the application, all the papers etc and we recieved a positive LMO for 3 years in june. I then sent everything to CIC, including the 150 fee for the work permit renewal as well as my application.

I was really confident that everything was going to go well, I called them (CIC) a couple of time and they assured me that if I didn´thear anything by then my application was propably being processed and that everything was fine.

A little over 2 weeks ago I got a letter from them in which they send my application back to me (case processed on August the 31rst - a week after my visa expired) telling me that since I didn´t send the right receipt for the fee and that I had forgotten to sign a document. They told me that I had to resend them my application as well as the missing receipt plus a 200 dollars fee for restoring my current status, which I did in a matter of days (I got their letter a friday and sent everything back in express mail on monday - they recieved everything on thursday the 13th of september)

Today I got a letter from my job telling me that without my new visa by monday the 24th of September they would have to let me go until I get the new visa.

My questions are as follow:
- how long does it take to restore a status?
- Am I still in an implicite status allowing me to work until I get the new visa (and therefor allowed to work) ?
- Is there anything I can do to prevent losing my job (which would mean losing my appartment and income)?

I don´t know if you will be able to help me by answering my questions but I thought I would ask as my world is litteraly crumbling in front of my eyes and I am desperate for some answers

My understanding was that if you are renewing a visa to continue working with the same employer then as long as your file reach cic office 30 days before the expiry of your visa , you can continue working legally.
You may verify this with cic and let your employer know.

Well I did send my application plenty of time ahead (almost 3 months prior to the expiration of my visa) However since they didn´t review it until August the 31rst (a week after my visa expired)they counted it as ´not recieved in time´ and sent everything back to me requesting the missing receipt + 200 dollars for a restoration of my status... (I sent everything back to them right away)
I will call CIC tomorrow morning I really need them to tell me how long it takes them to restore a status since without this restoration I will lose my jobe comes monday morning :(

As long as your application reaches the office before the expiry date on your visa you are considered to be under implied status. They were right to ask you to submit restoration fee as you had already lost your status.

My application had reached the CIC office in june so 2 months before my visa expired.
I am not contesting the 200 dollars has they had to ask me to resend everything with the missing receipt and the signature
My main concern is how long do they take to restore your status?? Is it as long as to issue a work permit altogether?

Hey Steph sorry to hear about your prob. I sure hope it is going to resolve in your favor. If you run into real trouble and need to continue staying in Canada, I am in Fredericton, NB. Let me know... I would be glad too host you for whatever length of time you need. Let us hope everything goes well...

I think, consulting with an immigration rep will be a good idea at this point, there should be a way they can help you.

Hello guys here are the updates:

I call the immigration this morning, the restoration process is as long as to get a work permit (roughly 75 days from the day you send your application/restoration request)

There is nothing I can do to speed up the work permit process as there isn´t an emmergency cell for CIC here in Halifax, NS

Plus they told me that a work permit was not considered an emmergency anyhow. I guess it depends on from where you look at it .. from my point of you it is very much so an emmergency..

All I can do is take a forced vacation and stay home (here in Halifax I mean) until I do recieve my new work permit...
It´s gonna be very thight as I do not know how I will pay the bills and the rent and food is certainely not on my list for the next two months...

Since you dont need a visa is it possible for you to apply at POE.This may be quicker if possible
