Agree with Sharon in correct advice to do a straight up tourist visit with U.S. passport. Should be ok.

Richard, I think you would agree that the more you try to hide stuff or manipulate CIC the more trouble you bring upon yourself. Every tourist risks being declined at the border - there is never a guarantee no matter what you do to stack the scenario.

It is better to make an honest attempt than to blow all your future chances out of the water because you tried to outsmart them. CIC has a very long memory.

Sharon- agree with you 100%. But I never saw anything in Randy´s posts implying he was hiding anything. Looked to me like a simple visit by an American citizen while spouse´s app is in process.

Roy and I got antsy when he started talking about withdrawing a current spousal application and applying for a visitor visa 8 weeks later like nothing was amiss under the premise that he was intending to go home after his 6 months were up. Smelled very fishy and screamed misrepresentation. Sure, you could say you did not have a current application with CIC but the minute they scan your passport... the jinx is up.

Randy is far better off to leave the application alone and prove he is coming for a visit with every intention of returning to the US in November with his wife for US thanksgiving.

I don´t understand why do ppl need to justify their thoughts, if you have been around for a while people already know what you think, don´t hang on to things too long, its just a forum, chill !!

when you take the responsibility of offering advice that affects someone´s life (as most immigration advice does), it is important to be able to be able to defend your answer. We all read questions posted here in very different ways. I would rather be questioned and correct my answer if I have misunderstood something than offer advice that proves to be harmful to someone´s future.

RANDY, THIS WOULD OF BEEN A BETTER WAY

Cross the border to visit your wife or a friend before any spousal sponsorship papers are submitted.

Then behave like me at the Casino last night pretend to fold then go all in. Well I lost but here it is.

If your visiting and you complete your out of Canada spousal sponsorship schedule one be sure to list your residence as state side because at that time your only visiting, then stay.

Your plan was so obvious to me and others here Randy why do you think CBSA officers at the border are less intellegent or worse at picking out liers.

If you have tickets to watch the Blue Jays loose with you and you have a reason to return after being with your partner they probably will let you in. Then if you stay being out of status will not make you inadmissable. Tell them the truth you want to wake up in the same bed with her next weekend, THEY ARE HUMAN! Give a good reason why you have to return and all shouold be okay but start telling lies and your body language will kill all of your plans.
