Subject: Marriage/Baby Question
  I m Canadian, working in the US on an H1B. My fiancee (American) is also pregnant, due in March. Besides that 2 pieces of extremely exciting news, we have some questions I m hoping some of the professionals on this board can answer...

1. If the baby is born in the US, can we achieve dual citizenship (US and Canada)easily? At all?

2. If the baby is born in Canada, what is the answer to the question above given the flip of situation?

3. How do I get my fiancee legal status in Canada or better yet, dual citizenship?

Pretty loaded questions - appreicate any insight you all may have.

I think first you should get married then

1. Baby born in US is automatically American, since you are Canadian you should be able to apply for citizenship for the baby (I know people who have done that though they live in Canada).

2. Yes babies born to American mother can apply for US citizenship through American embassies overseas

3. If you live in Canada, you can apply for SPOUSAL sponsorship (means you must be married) then she can get a PR then apply for citizenship. That is what I think maybe others in this forum know better. I am not 100% for question #3

1. Since you are Canadian you can apply for Canadian citizenship for your baby. Your baby will automatically have US citizenship (by birth in US).

2.If the baby is born in Canada then baby is Canadian by birth. To be eligible for US citizenship (in your case) these conditions have to be met: you (US citizen) must have lived in US for atleast 5 years before the birth of the baby and 2 out of these 5 years must be after 14th birthday.

3.Since you are a Canadian citizen you can sponsor your fiancee as a common-law partner if you have been residing together for atleast 1 year(you have to prove it) or by getting married. As a Canadian citizen you can sponsor her from abroad but will have to show that you have intentions to live in Canada.

Income is not an issue if you wish to sponsor your partner, residency is not an issue if you wish to sponsor your partner as long as you return the same day or before she arrives in Canada. CL sponsorships are fine if you choose to go that route. A marriage or CL application is the same you have to prove both and a marriage is not that great proof your relationship is real.
