Subject: Immigration to Canada from UK: Travel via the USA
  Hi

I´m at my wits end here, so if anyone has experience that can help me, I would really appreciate hearing from you.

My situation is the following. My wife and I have got work permits, and have booked one-way flights to Winnipeg from the UK. We are British Citizens and will be travelling on British passports. Our flight itinerary is such that we have to change planes in Chicago, so we thought that we would break the journey up by taking a two-day stopover there.

My question is the following: Will we need a visa to get into the States?

I have asked this question to the American embassy in London twice and received two different answers. The first was that because we are finishing our journey in Canada (which is an adjacent country) we do not qualify for the visa waiver programme, and must therefore apply for a visa before we go. The second answer was that because at the time we enter the USA we have not set up residence in Canada, we are officially residents of the UK still and therefore do qualify for the VWP.

If there are any British expats who have experience of doing this journey, I would really appreciate it if you helped me.

Interesting.

My impression was citizens of visa waivers do not need US visa under any situation.

I never heard any category of US visa for Canadian/British/Aussi...citizens.

Lets see if we hear anything else.

Very strange advice from the embassy. British citizens visiting the U.S. never need a visa. Agree with DC.

You don´t need a visa to transit through USA as a British citizen.

Thanks for replying.

After a third conversation with the US embassy, it seems that as long as we can prove our status of (legal) immigrants to Canada then we won´t have a problem.

Still doesn´t seem quite right. Even if a British citizen were to visit (not immigrate to) Canada, there still would never be a U.S. visa requirement.

The problem seems to be that we have a single ticket. I agree with you that it´s not rational, but this is what we´ve been told.

Anyhow, being that we *are* legally allowed to go to (and stay in) Canada, I don´t think that we´re going to have a problem. Thankfully! 8¬)
