Subject: What happens after appeal is allowed?
  Hi,

Here is a short recap of my process so far:

I am a Canadian citizen living abroad and sponsored my husband. Application sent in June 03 to Mississauga and then was passed on to the visa office. The medical was already completed and handed in at the time of the application. In November 2003 we got a negative decision as they deemed my husband criminally inadmissible. An appeal was made and the hearing was in Nov. 2004. The decision of the appeal is that the appeal is allowed on compassionate & humanitarian grounds. I received the offical documentation from the IAD in December 2004 which states that the visa officer must continue to process the application in accordance with the reasons of the IAD.

What exactly does this mean? How long will it take before I hear from the visa office processing my case?

Any help or insight would be greatly appreciated.

Depends why your husband is inadmissible, i.e. the type of the criminal offense. If there is a DUI charge or similar, they´ll usually overturn on appeal. However, if the charges are more severe, even though your husband may have paid his dues, they may not allow him in. The worse case scenario is a fugitive from international justice (war crimes, etc). Canada allowed dozens of people from former Yugoslavia to enter prior to the indictments of the International War Crimes Tribunal. Now, they are slowly being deported and stripped of their Canadian citizenship.

Thanks for your reply. I have the notice that my appeal is allowed and the officers decision to refuse a permanent resident visa is set aside and the visa officer must continue to process the application. The person representing the minister´s counsel told me that the application goes back to the visa office to further review which is what seems to have happened. I just wanted to know now what more they have to process or when I will hear from the visa office.

I was wondering if anybody has had an appeal for spouse from morocco and how long the process took to arrive in canada.it has taken six years and we are anxous to know how much longer to expect

i want to know what is processing time to appeal. i appeal in july. i recevied the booklet in dec 7 2012. but after that it has no response.
