Subject: just waiting for rejection
  i applied as a Skilled in 2002 and at that time i had exact 67 points and i calculated 5 points of my brother he used to live in canada and then he moved to U.S and his PR status has expired and now i hav less points and embassy asked me to submit all original documents which i did and now i m jus waiting for the letter for rejection so ....... is ther any wayout ?

This could be an issue. However, if at the time you applied for Canada your brother was a PR and living in Canada, that may be enough and what acually counts. The experts here like Balwant or Roy might be able to answer this question more exactly based on experience with their clients.

If I were you, I would proceed normally under the assumption that you submitted your application based on the family circumstances at that time. Don´t give up hope and see what happens.

From my experience with clients, if the brother is not residing in Canada at the time the file is being finalised, the applicant will not get any points.
The regulations state that you must have a close relative who is a permanent resident or citizen of Canada and he/she must be residing in Canada.
That is why CIC is asking for photocopy of the relative in Canada PR Card ot Citizenship card. They do checks on these.
You see the reason for this adaptability is that the new immigrant must not be a stranger in a strange country. CIC had the intention when the rule was implemented that the new immigrant must be comfortable in Canada when he arrives, be among close relatives, get advice and guidance from them and so on.

So if the brother leaves Canada, it defeats the purpose of adaptability, so no points will be given. Oh, they asked for an address sometimes.

However, if our friend here has a careless visa officer reviewing his file, he may get off.
PR status expired? No points as he is out of status.

I agree with Bally.

This post leaves too much out to interpret it any other way.

In 2002 the brother lived in Canada as a PR so if he MOVED to the States how was this accomplished WP/SP/Green Card Lottery????

The other issue is that normally friends help you get established far better then some family members may help. This is not a blanket statement it is just fact that some families are strained and are of no assistance to new immigrants ecept for five points.

yes i m agree with u guys but the situation is clear to u aswell but wat i do now ? my brother got sponsord from the company in U.S aswell so he preffered to live there so....

what else can you do to replace those points? improve your language skills, more job experience, more education?

all you can do is make every effort to replace those points and see what happens.
