Subject: Student Visa - Problem
  Hi,
I arrived in Canada last year on a visitor visa. I am originally from India. During my time here during the first six months, I applied to a college and was accepted. Prior to acceptance, I applied for both visitor visa extension and a student visa (mailed to Buffalo). I had sent in all required papers, including acceptance letter, proof of funds, etc. As my visitor visa extension was being looked at, I was living in Canada under "Implied Status". A few months later, I received a letter stating that my visitor visa extension was rejected. At the same time, I never heard back in regards to the student visa. So I decided to stay in Canada until I received some information from Buffalo. One day about six to eight weeks later, I received medical processing papers from Buffalo. I am still currently in Canada and will be going to get my medical done (at a Doctor in Surrey).

My questions are:
(1) Am I under illegal status at this point in time? What is my status?
(2) How long will medical processing take?
(3) Will I most likely be called for interview? If so, will it be in Buffalo?

I am amazed that CIC is not consistent, at least here and and at Buffalo.

I thought that you cannot apply for a Student Visa in Canada whilst here on a Visitor´s Visa. They normally tells you to go back to your home country and apply for a Student Visa.

I would like to hear what others have to say about this.

I sent my application to Buffalo, which obviously, is outside of Canada.

What I did was used the address of the people who´s house I am staying at, on the application. They are my relatives, and they live in Surrey, BC.

I would also really like to know what others have to say and their advice. I am scared to call CIC to clarify as I may be doing something wrong.

Rishi, you have to convince the visa officer that you are well established in your country of origin and return after completing your course in Canada, while applying student permit within Canada result an adverse effect on these isuues because you are not applying within in your country, so chances for rejection high.

But I have been asked for medical. Is this not a good sign?

Does this mean I can still be called for interview? I can still be rejected?

Rishi,

From my experience with clients, when they are asked to submit Medicals, it is a sure sign they will be successful.

I had never had a client who submitted a medical and an interview was requested afterwards.

In my opinion, things are looking good on your side.

But I still maintain, how come your student visa was not processed in your home country and in Buffalo? When you are on a Visitor´s Visa, you have to return to your home country and apply for the Student visa.

The immigration system works in mysterious ways, eh?

What is " Implied Status"? Never heard that term before.
As far as I know, you either have status or do not have status.

In your case, I think you do not have status. But I may be wrong and I would appreciate others views, especially on " Implied Status".

When I applied for visitor visa extension, it was under processing by Canada Immigration. Since I was not given a definite yes/no, my initial visitor visa expired. I was told by Immigration Canada that I could stay under "Implied Status" until I received a result in writing.

About eight weeks ago, I received a letter in the mail from Immigration Canada, refusing my visitor visa extension.

Since then, I have been living in Canada and never bothered to go back to India during this time. A few weeks later, Buffalo centre (where I applied to in August) sent me medical forms to the address where I am currently staying (Lower Mainland BC).

Since I obviously do not have status, should I go back to India, or continue to stay? Also, how do I get my passport stamped if I am living in Canada?
