Waiting for new German Passport in Canada

Subject: Waiting for new German Passport in Canada
  If anyone can help me with this question, it would be much appreciated.

My SO is from Germany, and is on a visiting VISA, staying in Canada.

His visiting record expires on the 11th of November.

He has had to renew his German passport, as it expires on the same day.

He has done his application for renewal by mail, and the paperwork and fees were sent in the middle of September.

We still have not received his new passport as of yet, and are currently trying to track down the money order to see if at least that has gone through yet.

We were told by the German consulate, to cut down time frame of processing to mail his passport with the application, so this is what we have done. So he does not even have his passport with him, just a photocopy of the passport and visiting record.

My question is: What happens if he has not received his new passport by the time his visiting record expires?

Will he be classified as being here illegally, or is there a time frame that this is not the case, as he is waiting for his new passport?

As for renewing his time here, he made a trip to the US and back to Canada and asked for a years visiting record, so we had time to come up with the documents we need for myself to sponsor him.

At the time, they were going to give this to him, with no issues (a first for us dealing with Immigration), but after halfway through getting the papers ready, that is when they noticed the expiry to his passport was the 11th and could not grant him time, past when the PP expired, so they said to renew the passport and come back again when he has the new one.

We are worried that him possibly staying over his visiting record, due to having to wait for his passport, may hurt us, legally with coming back in.

Any input to this is appreciated.

Hello if you are married or common law and plan to sponsor your partner He or she does not need to have a avalid vistors permit.The fact that you plan to sponsor him under the (spouse or common law partner in canada class)he does not require to have valid staus in canada.Check out citizen and Immigartion Canada web site.
