Subject: My application returned, please help
  Hi,

My application for SW was returned by CIC and have been advised to send following documents. I have stated that I am in US on L1B visa

CIC wrote that

You must provide evidence that you have been lawfully admitted to US for a period of at least once year. The document must indicate the date you were admitted to USA and validity of the document(s) issued on that date. Please also include evidence of extensions after that date, following document out of a list are ticked

1) Current or expired status document
2) other L1 visa supporting document

In the list they have not however not ticked the I-94 card.

At the time of application I had submitted copy of my passport and US L1 visa which has issue date and expiry date ,and date of my entry in US , so what else they are asking ?

What is the status document and other L1 visa supporting document they are reffering .

Should I submit my L1B petetion and I-94 or something else please suggest

The issue is HOW LONG were you admitted to the States for! Whether you´re RESIDING in the States at the time of submission.

Not whether your in status or not NOW.

Look for regulation 11 of the Immigration and Refugee Protection Regulations.

You have to submit I94 showing the date of entry and the date of expiry. that gives CIC the information of how long you are admitted to US.

Let me know in case any other info is required.

Visa & I-94 are not the same.

Visa shows the validity of your entry; till what date you can enter. I-4 shows the exact date when you entered into the USA and till what date you are permitted to stay. if you don´t have any extension, then that´s the only proof of your legal status in the US. If have extension, then add the copy of extension/2nd I-94.

Though I wonder why didn´t CIC tick the I-94 option as you said.

Thanks Roy, Praveen and DC for your replies.

I came to US in Jan and since then I am in US and my I94 and L1b visa are valid till December 2009.

I will send I94, my L1 petetion approval letter and my house lease agreement here in US . Anything else you guys suggest ?

You I-94 card should be sufficient, that´s the missing puzzle consulate is looking for. They want to make sure that you are lawfully admitted into the US for at least 1 year.

Hi Rajiv,

i think u wrote u entered in jan 2007 ..if so u have not completed i year in US.
I am not sure but i think u need to be in US for at least a period of i year before applying...so may be they are looking for i-94 card for same.

Just check on it.

i am sorry what i meant was have u need to complete "ONE YEAR" before applying

which will be only clear from i-94 card

Nidhi,

No as per my understanding if you have entered US and your I-94 says that it is valid for at lesat 1 year since the time u entered, then u qualify to apply for canadian PR even though you have not completed staying in US for 1 year.

I had not submitted I-94 before as they had not mentioned it anywhere, they only mention submitting the US visa which I did. I just resent everything again , hope this time everything will be fine.

Hi,

i do not remember from where i got this info but i am sure i read it somewhere .i am trying to search that info ,as soon i get it i will post ..Anyway u have send your i-94 now , in case "one year" is the prerequirement,,they will specify it.keep yr fingers cross:)

Thanks for your inputs.

This is given in cic web site at http://www.cic.gc.ca/english/immigrate/skilled/apply-how.asp

and they say for regular process

"you have been lawfully admitted into the United States for a period of at least one year and you are submitting your application at the Canadian visa office in Buffalo."

Now I am lawfully admitted to US till the end of my visa which is in 2009 so I satisfy the criteria
