Subject: TRV for my wife
  Hi all

Just 1 quick question..

I´m a PR and i got married to a lady after i got my Canadian PR. She is livining out of Canada and now she wants to visit me for a month.
Can i apply for a TRV for her while they know that she is married to a PR?

she can apply with an invitation from you BUT, how are you going to convince Canadian authorities that she will not change her plans and simply stay with you in Canada permanently without going through the proper application process.

She will have to demonstrate beyond much doubt that she will return home at the end of the perscribed time allowed.

Why have you not sponsored her?

Well i know that even if she decide to stay permanently in canada.. that wouldnt be unlegal.. thats the new immigration law
i can apply for her while she is out of canada or bring her and apply for her within canada.

She visited canada last year before we got married.. will that support?

I doubt it. In theory, you should both be trying every possible means (in and outside CIC rules) to be together. That is what married people generally do. They don´t want to be apart one minute longer than they have to.

So, why have you not begun the sponsorship process will be CIC´s first question. They will assume you have every intention of doing so but from within Canada so your spouse can be with you sooner. The only way to do that is for her to violate the terms of her visitors visa.

You will need to find a way to resolve that question for CIC.

well the reason that i haven´t started the process is that im still not compeletly setteled in canada.. i go between saudi and canada.. thats why we didnt do it yet
i see her from time to time.. and now she wants to visit here.. and when im compeletly setteled i will apply for her
since they told me that i need to be living in canada while processing her case!!

yes, you must be in Canada to sponsor her. The next question will be - did she marry you to gain legal entrance to Canada. There does not appear to be intense urgency to be together so you would have to show CIC that your marriage is genuine. You are caught both ways!

By all means, give it a try. The worst that can happen is that they say no. Perhaps you write a note in the invitation to explain why you have not begun the sponsorship process as yet and they will accept it.

Sharon I have read in many other posts (on various sites) that it is possible to sponsor a spouse while living outside Canada.
That is, the couple simply doesn´t want to live apart from each other for 9-12 months while waiting for the paperwork.

Can you please clarify if this is possible?

if you are a Canadian citizen (rather than PR) you have the option to sponsor your spouse while both of you are outside of Canada. If you are a PR, this is not an option. You must show that you will both be returning to Canada through things like a job, a house etc.

As a PR you can leave Canada after the application is made but you will need to be mindful of your status requirements, etc. Any sort of lengthy absense from Canada may result in some CIC hassles with intent. I would be reluctant to spend the entire processing time out of Canada.
