  I got law master degree in the states 12 years ago, current corporate cousel mostly working in English related to English contract review, negotiation, litigation in the states, etc. I took TOFEL 12 years ago for 600. Do I still need to take IELTS to prove my English ability when filing the application? Will the officer might release after my interview or I will be directly disqualified if I cannot provide the test result in the interview?

TOEFL doesn´t work. That is even not valid anymore.

Need to take the IELTS.

CIC gives you a choice - take IELTS and guarantee your score or write a declaration of proficiency and give up your ability to contest the points assigned for language by CIC. I suspect you are well over the required 67 points even if CIC gives you 12 points for english instead of 16.

Based on what you are saying in your post... I would go the written proficiency route unless you are nervous about your point total. If you claim 16 and they are not happy - well, they may say go get your IELTS or simply assign you fewer points.

Actually my score net of Language is 66, and need 1 more point on Language to pass the 67 bar. It´s nice to know I can write a declaration and be scored by the CIC officers, and I believe I deserve at least 1 point. Before Sharon´s reply, I just don´t know if the IELTS is a must or the only way to apply. However, I realize that taking IELTS will make my application easier and I don´t even need an interview. Thanks a lot for help.

did you say 66 points if you get 16 points for language ? Please tell me I misunderstood you !!

You will not get 1 point extra for the declaration once you are asked to give IELTS (is that right guys ?)
Make sure that you calculate your points properly. Without maximum points for language you need to be at 51 points atleast, so that if you score good in IELTS you can get to 67 points.

I got 25 points for my master degree, 21 points for working over 4 years, 10 points for age 36, 10 points for spouse´s master degree and my mother is a Canadian, that´s 66 points in total. That´s why I say I only need 1 point to pass. By the way, I am currently an in house corporate cousel (legal manager, leading 6 legal staff in a company), not admitted but have been providing legal services for over 10 years (as said, contract review, negotiatioin, corporate litigation handling, etc.), under NOC, shall I be classified as 4114 laywers and quebec notaries, or 0114 other administrative sevices managers?

read it again Raj - she has 66 points NET of language. She needs 1 point for english to reach 67. As I suspected, Sylvia has points to burn.

Sylvia has not filed yet. If she is asked to take IELTS, obviously she should do so. A declaration of language will not force an interview. If your documents are in order and your points are well over the minimum, I highly doubt there will be any reason for an interview.

Write a nice letter explaining your education, training and daily usage. Attach proper documentation. You should get around 10-12 points without IELTS. If you are lucky or the IO is nice, may be more. You only need 1 point, so why waste money on IELTS.

Anyway, Sylvia, you posted your explanation within seconds of my answer. I think we crossed paths but it is as I expected.

Based on the type of job you have and the level of language you would require to perform at that level I would think 12 points is a ´gimme´.

Once you are the 67 points, the rest is gravy.

Good luck! you may want to investigate the PNP programs for the various provinces. There may be some opportunities that could fast track your application.
