Subject: Please Help urgent
  Dear Sir,

I become permanent resident of Canada last year in April. I live and work in UK. I came Canada in April 2006, stayed for 10 days and then came back UK. They sent PR chard to my relatives address and then my relative posted PR card to me in UK.

Now my questions are

1) If I re- enter Canada in Jan 2008. Will they ask any questions in immigration of where i have been?
2)I have read on Canada´s Official website that I can live outside Canada for 3 years and still maintain my PR. Is this rule still in place or they create problems if somebody live outside for 3 years and then come back.?

3). I intend to set up my IT company in Canada early next year and then I will create websites freelance for people in UK and invoice them from my Canadian Company. How can I set up company and pay taxes to Canada while living in UK?

Will I count residency days this way as I will employed for Canadian company.

Please advise me as my UK employer does not want to lose me and I dont want to lose my Canada PR.

Setting up a company depends on which type of company you wish to set up. Sole Proprietor, Incorporation etc. Most can be registered within a day. Name Searches of Incorporated names can take more time but plenty can be done ON LINE.

Applying for permanent residency and only staying ten days seems illogical. Staying outside of Canada for longer period of times can be motivated by income resources though.

Yes working outside of Canada full time for your own company will count towards residency days. You need to google the IRPR regulations and read the requirements on residency when it comes to paying taxes for your company and yourself.

Hi Roy,

Thanks for the information. Like Ahmed, I would like to get more information on this situation as well. If I incorporate a business in Canada and move to another country as an employee of that business (getting paid a salary by that business), would I be able to count the time outside Canada for residency requirement?

I googled “IRPR regulations” as your suggested, but didn’t get any document that made any sense to me (I am not lawyer), however, I came across the following CIC site which explains the difference between basic residency requirement and physical presence in Canada. The page goes on to state that if the physical presence is less than 1095 days, the grant of citizenship would depend on the citizenship judge, and is not guaranteed?

On some other sites I have read that while some citizenship judges take a liberal view on the physical presence requirements, other judges take a rather hard line view. So, is my assumption correct that after three years (of which up to two years maybe outside Canada, working for a Canadian company) there is no guarantee that citizenship maybe granted?

Please clarify how this situation may work and what are the best ways to ensure citizenship in this situation.

Hello Sharon,

my projects will be finished by the end of next year and then i will permanently settle in Canada. in the mean time setting up IT company will help me in residency days and i dont have to look for job when i come next year.

Hi Roy,

Thanks for that link. Its clears up a few things. Interesting paragraph under (Exclusion):

"(2) For greater certainty, a Canadian business does not include a business that serves primarily to allow a permanent resident to comply with their residency obligation while residing outside Canada."
