  Hi,

I wanna sponsor my spouse, she is visiting me in Canada. Where her file will be processed? It´s her home country or by CPC-M (Mississauga) ?

What if we file case in Home country (India) and then she visit me in Canada (She has got 6 months Canada Visa).. do I have to intimate CIC about this? If yes then do they send this file to some other office?

1) What will happen to her file if she visit Canada during her file processing from her home country..?

2) What if she visit me in Canada and then I file her case..? what will be processing in two different cases?

It´s so confusing to find all these details..Pl. advice.

You have two options to go about spousing your spouse while she is visiting you in Canada:

1) Since she is legally in Canada you can have her application processed from within Canada. These applications are handled by the CPC in Vegreville, Alberta. If you went this route, once she received her Approval in Principle (which takes about 6-7 months after they receive the application) she would be able to apply for an open work permit. It takes anywhere from a few months to over a year for permanent residence to be granted or denied after approval in principle...and if it is denied there is no appeal process so if you want to retry for permanent residence you would have to do it through a visa office outside of Canada in her home country.

2) The application can be processed outside Canada by the visa office in India, despite the fact that she is legally in Canada. If you went this route, the complete application would first be sent to the CPC in Mississauga where they would approve you as a sponsor. Once sponsorship is approved they send it the visa office that is responsible for her home country (that being India). The office in India would then process her application according to their processing standards, if an interview is required she would have to return to India to undergo it. If permanent residence is denied, applicants have the right to appeal the decision to the Immigration and Refugee board.

If you file her application through the office in her home country, I would recommend letting CIC know that she´s currently in Canada on a visitor´s visa. She will need to include a mailing address so that the visa office handling her application can contact her, and unless she´s planning on returning to India very shortly, that address should be the one she´s staying at in Canada since that is where she currently is living. If you put down a Canadian address, she will have to include a copy of her current visitor´s visa with the application.

Nothing will happen to her file if she visits Canada while it is being processed. The visa office just will continue processing it.

As I said in response to your first question, it will depend on where you decide to have the application processed - inside or outside Canada. If she visits you and there will most likely be a problem should she have to return to India for an interview, best reccomendation is to use the "In-Canada" application and have it processed in Vegreville. If she files the "In-Canada" application she´ll have to be sure to maintain her legal status in Canada until she´s granted permanent residence. If, at any point while her application is being processed, she loses her legal status she´ll no longer qualify under the "In-Canada" application and her application will be denied.

Sorry if this seems like a lot, but there´s a lot to consider. Just so you know, my husband is sponsoring me for permanent residence. He´s Canadian, I´m American. Despite the fact I´m currently residing in Canada with him on a visitor´s record, my application is being processed by the Regional Processing Centre in Buffalo. We sent the application out in the beginning of July. Hope this helps a little...if you have any other questions just ask.

hi, I have a question regarding my status, my refugee status has been denied and I would like to take a judicial review, and it is going to take about 1 year, while I am waiting for that I have my auntie who wants to sponsor me, so can I apply for a sponsorship while I am waiting for my judicial review ?? Thank you
