Subject: the decition
  my file at the last step but i took the IELTS exam i got the 5.5 and my lawyer said they need the 7 which is hard i think. i got my master degree and i have worked in the USA in 2000 they gave me a letter of recomandations from the company i have worked at. do you think this will help me to get pass my file in a good shape and get the result i am looking for. because its a prove that i can speak english very well.

IELTS gives you points in each category not by overall points.

you total point requirement on your application must be 67. The maximum you can receive for language is 16. How many points do you need? The 5.5 is only part of your score - what is the rest?

a letter from your employer will not be sufficient. Your post suggests that your english is not as good as you think it is.

How much time do you have to provide your IELTS score? is there enough time to study and retake the test? I suspect that is your only option.

Did you take IELTS or not? If you did, how many points did you get in each category? How many points do you need to be above 67 (so, what are your current points without any English profficiency)?

i took the IELTS exam i got (5) in listening (5.5)reading (5)writing and (7) in speking the overall( 5.5 )and i think my points in the 60 without the engilsh

If you got 70 points Why are you going for IELTS exam !!!
67 points is enough. And you have the max. 16 points on Language.
Who asked you to go for ELTS exams??

Shan is going for IELTS because he claimed he had 16 points which is full proficiency. Now he took the exam and he got 8 points total- ooops. That puts his total below 67.

and now he has a problem!

Well it is now few weeks after your posting but I feel that my experience may help you and others... I applied to immigrate to Canada with my family almost three years ago... I just got the request for medical examinations so I am far from done... but when I first sent my application (I did not use legal rep) I wrote I letter explaining that I lived and studied in the USA and that I used to work there and how I was able to purchase two home while there and sent all sorts of documents to prove my point... income tax reports, reference letters, pay stubs etc... and I guess it worked! They recently asked me to have the medical examinations done and they never said anythign aobut having to take the IELTS test ... if you lived and worked in the US and you have a degree and work experience from there... this sometimes could be enough... but I guess it is up to the immigration officer to decide whether or not to ask you to take a language proficiency test... but... I think for future applicants.. if you feel confident and you know your English or French is good... you know you can function fluently using either language... why not save some money... write a letter explaining and see what happens... if later on they want you to take the test, then you take it but you may not need to...
