Subject: Divorce while aplication is still pending
  My wife and I have applied for an immigration visa to Canada 3 years ago. She is the principal applicant. We got the provincial nomination from Qu?bec last year and are currently waiting for the Canadian authorities to contact us for the medical exams after which they may grant us an immigration visa. However, we have both come to the point where our marital differences are irreconcilable and have agreed to separate for the time being. We are both on friendly terms, there exists no animosity and have an understanding. We are not in Canada.

What I would like to know is the following:
1. Should we notify the Canadian authorities of our marital situation, as a separated couple and how would this affect us?
2. Should we divorce and notify the Canadian authorities? if so then would it be possible to separate our applications? Mind you she is the principal applicant.
3. Should we make no declaration, wait for the medicals then divorce and let them know?
4. Should we make no declaration wait to get the immigration visa, get to Canada and then divorce?

Any other suggestion will be swell

Note: I generally prefer to be honest and would choose #2. But the thought of having to start the process all over again, applying as a single man, and waiting an x number of years more is disturbing. I also do not want to ruin her chances of going to Canada. Also note that we are not using the services of an immigration consultant.

Your advice in this mater is much appreciated.

How desparate are you about moving to Canada? If you are desparate enough, it should ok to play it cool; tell your wife you would like to quietly go through the remainder of the process and then if she wants to stay back in the Old Country, she can and you take the flight! For real. You can entice her with this idea: if you go to Canada, you might become a better paid laborer, so you can send more cash to her in support of children and such.... she just might let the stuff slide through. Once you land in Canada, you can sit in the Igloo and wonder what the hell you came for! to the damn frigid chuck of land on the North pole. LOL. Take it easy friend...

thank you for your reply. but I think I need more details. is it legal to be separated and go to Canada both under such false pretences? will we have to live together or can we have separate addresses?. what if I decide to relocate my permanent residence to British Columbia? we don?t have any children and thus have no kind of obligation towards each other. we both badly want to go to Canada because where we live now, the middle east, is just not a place that fits our description of a place of opportunity and civilized societies.. let alone the lack of professional ethics and abilities

Well honesty is the best policy, I think you can make her your legal partner (if your wed or your devorced got approved).
