Subject: H1-B Expired
I was layed off as an H1-B visa holder (temp worker) in US, but I did not return home, and overstayed my H1-B visa. Do you think this can hurt me when I apply as a skilled worker for canadian PR? Thanks for your help.

No, that is not even considered in the equation. But make sure that you cite your status truthfully on the skilled application. CIC is not concerned about the status in another country. They would be concerned about any deportation history, however. I am sure that does not apply to you.

In another internet entry, Anonymous correctly states that you cannot apply from the U.S. if you are not legally supposed to be in U.S. You would need to return to your own country and apply from there.

My original positing was based on my application in which as an American I am principal applicant, and my foreign partner is on overstay but not principal applicant.

I am truly sorry for any confusion, and I thank Anonoymous for catching this error in a timely fashion.

Thanks for taking some time to answer my questions. However, your two answers seem to contradict each other. So what is your final thought: Can a quilified "Skilled worker" with an expired status be approved by Canadian authorities, or NOT? Thanks again.

According to all of the manuals...you can apply in the US if you were admitted legally to the US for at least a year. It doesn´t say anything about being out of status now. So, if when you were admitted to the US, it was for at least one year, you are eligible to apply at Buffalo.

While the CIC does not care if you are currently legal or not, they might ask ya for paystubs, if you can´t get a certificate from current employer. I think the Canucks for some unknown and strange reason, seem to dislike unemployed people! Does it suggest they might become a future burden? I work for the US Govt but still was asked for paystubs!
