Subject: Have completed 3 yrs in 4 yrs but traveled lots!
  Hi Folks,

I am seeking advise. I have completed my 3 yrs in 4 years, but i have traveled a lot. I calculated in my excel sheet my entry and exits and it is coming down to around 22 trips to both Pakistan and Dubai (where i have a branch office) I want to know, will this delay my case? I was advised that if i have traveled too much then my application might go to a judge. Now i`m operating a full time business in the UAE and i want to shuffle myself between the two countries as I have some interesting projects lined up both in uae and canada. Also I recently went back to pakistan to get married, my wife holds a eu passport, hence she will join me in a month or two while i look for an appropriate accommdation for our new family. Can some one advise what i can expect? And should i apply for the citizenship now?

If I apply now and go back to U.A.E and come only when the test comes, is that a better option, or i should keep shuffling.

I want my wife to be at one place, so i just go for my passport?

Also who do i report about the marraige and how?

I don´t know enough about citizenship requirements to respond, however... citizenship is not automatic - you must apply. I would also expect you will need to validate your residency in Canada during that time. Roy will have more info... and I am sure the CIC website can also assist.

As for your wife, if you want her to have status in Canada, you will need to sponsor her. To do that, you must be residing in Canada.

If you wish to take out your citizenship but have your wife remain in the UAE, you will still need to declare your marital status. The question might be asked why you would want to have your wife living in another country.

Ok i`ll look forward to hear from Roy.

Also how do i change my marital status? Should I call her to Canada? Right now she has a eu passport so she can enter, but i don´t intend to apply for her, becasuse of my business obligation, when we move back to canada, i can always apply then!

However I would love to hear about this from Roy.

as a landed PR, you are not obligated to advise any change in marital status.

You need to verify if you are putting your PR status at risk with the amount of time you are spending out of the country. Citizenship is the least of your concerns.

As a woman, I struggle with the notion of her being one place and you being another, but I guess my standards of relationship and commitment have a different criteria.

Should you call her to Canada? she cannot work here, she has not medical coverage here... what would be your purpose if you only intend to marry her but not sponsor her? What does your fiance think of all this? I know what I think!

Hi Sharon,

It´s not like that, I would love to sponsor her. However for that we would need to live in canada for another 2 years. While i love being there, I`m now obligated to be in UAE for business purpose and am tired of coming/going, in a year or two when things stablize, i`ll be delighted to sponsor her, you are right about the health issue, however i work full time and God willingly will support both of us.

How can i check the status of my PR. is there a way? According to the calculations i have completed the obligations of being in Canada.

I`m also plan to open up my rental company in Canada once we stablize in UAE, which is right now booming.

why do you need to live in Canada another 2 years to sponsor her? establish residency and sponsor her tomorrow!

You can be a millionaire and health care without insurance is a dangerous thing.

you need to be living in Canada 2 years out of 5 to maintain your residency.

UAE will always be booming. Perhaps you should establish your family there.

Oh now i get it. she will be a PR but not a citizen until she completes her required time of 3 years? Ok got it.

but what about YOU! have you been in Canada a full 2 years out of 5 and where is your permanent address? UAE or Canada or Pakistan?

nothing wrong with travelling for business but Canada has some rules about residency.

Please read my post again, I have COMPLETE my 3 years of physical presence in Canada within 4 yrs, so that is not a problem. I`m a permenant residence right now of Canada, however i also hold a UAE residence visa (because you need it for a company, driving license etc).

I just want to clear out what laws did you mena?

1095 completed in almost 1400 days.

If i meet the above, am i not good?

Accordign to the information that you provided, your PR ship is OK, you even can apply for the citizenship. If needed then they may send it to the judge, though likelihood is less.

You are eligible to sponsor your wife also as you are maintaining your PR ship. Do you file tax regularly? Financial solvency is not needed for spousal sponsorship, but they´ll ask for that to validate your PR status. Also, according to the law, you are supposed to pay tax to Canada in your UAE or Pakistan income if claim residency there.

yes, your PR should be good. Your original information made it sound like you were out of the country more than that.
