Subject: Study Permit, Landed Immigrant Status???????
  Hi, my name is Rai and I have a query about a really complicated situation.
My parents moved my family to Canada in 1999. They both had workers permits and were working under contracts for a Church group. In 2001 when their contracts expired they opted to apply for Refugee Status than rather go back home where they were being religiously persucuted for converting from christianity from Islam. We continued living in Canada untill 2006, whic is when our refugee claim was denied. I entered canada at the age of 12 and left when I was 19, I had graduated from high-school in canada and left after completing my first year of Pre-med (Bachelore is Science - Cell Bio). At the moment I am in South Africa my country of Birth and I am planning to return to Canada on a Student Permit to continue my Studies. My question is what advice or cause action should I take once returning in regards to attaining canadian citizenship?

You write like a person too young to understand the rules. You were admitted for a temporary period (regardless of your age) in 1999 and for what ever reason did not comply by leaving when your status expired.

Now you think that obtaining a student permit is a done deal!

Think again.

Roy, not that I think it´d be easy for him to get a study permit, but was does your response to him/her do? Rai came in here when he was 12 and didn´t leave at 14 when he should have with his parents. Was that his fault? Somehow, he should have returned home without his parents? I have no clue how exactly this would play out but seriously, your response was rather uncalled for.

Wow really not responses I was looking for, but meh what can you do. Well to answer Roys reply I have already obtained my student permit and i am returning to canada. Th reason why I gave such an extensive background by including age and such, was to help those understand my situation. And by the way My complete family have resided in Canada for the last, almost 8 years. Nobody left me behind??? I grew up in canada that was all I was trying to convey. I dont get why you have to be insulting? And you make it sound like I stayed in the counrty illegally or something, actually I really dont get what the intentions behind your message is or was? All that said and done, what I am really asking is does my past stay hole any relevance to my future application for Landed Immigrancy?

overstaying a work permit is illegal, and a failed refugee claim would suggest that CIC did not accept that arguement to stay. Even if Rai was not the adult, the infraction still applies to his passport.

Now, he is suggesting he has successfully obtained his student permit. I guess CIC was feeling trusting - they don´t usually give people a second chance to break the rules.

So, in answer to your original question, citizenship is not even a consideration at this point. If you have been admitted to Canada for 1 year, you are eligible to apply for permanent residency as a skilled worker. This gets done through Buffalo. You will require 67 points and the process is taking about 2 years.

Does an international student who spent 1 year studying in high school [on study permit] in Canada qualify to apply for landed immigration status after the 1 year? The said student is now admitted in a university, and is over 17 years old. I wish to confirm or dispel what info I got previously.
