Subject: Please help, advice about Schedule 1 Background..?
  Hi,
My spouse, whom I am sponsoring, was detained at Toronto airport in 2005. At the time, he was attempting to visit me. When he arrived, he had been drinking somewhat and the immigration officers really grilled him, so he got frustrated and somewhat angry, and when they demanded concrete details of what he was planning to do during his visit, he eventually explained he was going to visit me and provided my Nana?s phone number.
So I received a call from immigration, which my Nana and parents answered, and since I was only 16 years old I pretended to have no idea whatsoever who the person was. I thought it might be the safest way to go. As a result, my spouse was detained at the airport and sent back to the US the next day.
It is now 2 and a half years later. I married my spouse a few months ago, live with him, and my parents are fully aware of the relationship. What I need to know is if this detainment would have been kept on record, and if it needs to be reported on the "Have you ever been jailed/detained..." section of the Schedule 1 Background Information Form or if it wouldn?t have been kept on record/doesn?t really count as being "detained/jailed" and therefore there?s no need for us to mention it.
I?m scared it might ruin our chances of going to live in Canada together. Also, there is a large age difference between me and my spouse. I?m wondering if immigration will frown upon the fact that I?m only 18 and refuse my application to sponsor.
Then, if anyone has enough time to answer even more questions (!), if the application doesn?t get refused etc., how is the situation with the FBI record? How long is it taking people to get their record in America? I read on the Canada immigration site about 3 weeks, and on the FBI site about 16 weeks, so it?s a little worrying. We need to be in Canada before September, by the time I start college.

Tell the truth and really prove your relationship. Make sure you include a one page 12 font letter why your relationship is genuine and explain what happened previously.

Police reports in the US do not take longer than 4 weeks to be issued in most cases... we applied for ours from the U.A.E. and got them in way less that 16 weeks...
About a record of arrest at the airport for your husband... I am sure you could request a police report for him in Canada just to be sure... but in most cases if they just held in at the airport and sent him back for misconduct or something like that... and if they did not finger print him... I am sure there is no record... if he had to provide his finger prints then... almost for sure there will be a criminal record... he should be able to know what they did though... good luck!
