| Subject: how can the passport be sent from india |

Hi All
I have been requested for the passports for myself and my wife in london for the permanent immigration.My wife is in india and her visa has been refused 2 times and also she made an appeal which was turned down.She tried to send her passport by courier but was returned back?How can she send her passport?I,m in big problem please help?

according to indian law its against the law to send the passports out of the country, even if she manages to send the passports, still while leaving india at the airport immigration she can be booked for gaining visa in absentia, and tried in the court of law, this has happened to many people but still u can ask a lawyer which is based in india that will be helpfull for u.

It is illegal to mail passports from India, no fedex , DHL etc will take this unless you do not tell them - you can state documents and send this- many have done this - but I do not think it is worth taking this risk. More important if you do manage to get this done and after getting the passport stamped in UK when the finally the person boards for Canada from India would not the indian immgration authorities detain you noticing you never went to UK but your passport has a stamping from UK this means your passport travelled illegally? I would suggest meet somwhere near UK where visa is possible take her passport, you travel back with an authority letter from her authorizing you to carry her passport for Canada immigration stamping and while she waits in that place you get the process done and return back with passports stamped.After which you can move to Canada. This way you do nothing illegal. I have friends who did this. But an authority letter is must as it is illegal for an Indian passport holder to let this out of her possession. Read the back page of passport. Also check the Forum search - mailing passport. I have heard that you can do this through Ministry of External Affairs in Delhi - they give you a letter after which DHL takes this.All the best!

As mentioned by you can i then get the passport by somebody else who is traveling to UK and my wife can give her the authority letter mentioning as u said?i mean instead of me traveling can some of my relative who is traveling to UK can get it?Would that be legal?Plz reply

how will it be possible to meet any where near uk, i mean if he calls his wife to say for example germany and brings back the passport to uk, and if the visa takes 1 or 2 months to arrive than can the wife stay alone in a unknown foreign country.

No i mean if any one of my relative/friend who is coming to UK gets my wifes passport from india to UK with the authorisation letter. and then i can get the visa stamped and take it back to india..I mean i have relatives/friends visting UK from india..one of them can get the passport..wod tht be legal thn?

You can always send the passport through someone who is going to London with a letter of authorization. This is perfectly legal. Also, I tried to look for Indian passport act and did not find that it is illegal to send passport across country´s border (some consulates do say so). It is written though that "Passport should not be sent out through mail from the country of residence".

Thts fine i dont have any1 who i knw comin to UK now..But if my wife courier me the passport how would anyone get to know was the passport sent by courier or was it hand taken by someone who travelled to UK..

Nobody will ever know but what if the customs confiscate it? They will probably hold the passport for few weeks before returning it back. You may also face some legal problems. One thing your wife can do is to go to a country which has no passport mailing restrictions and from there she can mail it you. You will have to hope that she will get her passport back in time.

Thats a nice idea..Could you tell me which country would be the best to visit like china?mauritious?near to india which doesnt have any mailing ristrictions..
