Subject: FSW applicants have to do their own research.
  To All

So many people on this forum and others believe that any application for Permanent Residence filed overseas or inland can be done without assistance. That statement is true to a point, based on each persons personal circumstances! Many should never do their own applications without assistance but lots can get away with doing their applications themselves.

IF YOU DECIDE TO USE ASSISTANCE OF ANY PERSON OR FIRM YOU ALSO HAVE AN OBLIGATION TO DO SUFFICIENT RESEARCH YOURSELF. ASK LOTS OF QUESTIONS BEFORE YOU HAND OVER YOUR HARD EARNED MONEY!

Everyday, I consult with people who have screwed up their applications and most of my income comes from spousal appeals from these people who did their own applications. YESTERDAY I SAW A SAD, FSW CASE.

I do not like to take any client who wishes to submit a FSW application because mainly the processing times and since it now is only a SAP. Three to _____ years of calls asking me, "any news on my file"?

Yesterday, I consulted with a Lady from India who has hired a firm in Mississauga to assist her with her FSW application. The Lady in question has parents and siblings living in Canada. Her main duties is NOC 1244 a Medical Transcriptionists and she is working in Kuwait doing those main duties.

Question 11 of her Schedule (3) form (COPY) which had to be completed when she submitted her application, had the NOC code box not only empty but the whole row of NOC codes boxes were missing! http://www.cic.gc.ca/english/pdf/kits/forms/imm0008_3e.pdf

The company never suggested she complete an IELTS assessment and question 6 is not even checked off YES or NO!

Now what can she do other then trying to seek out an employer. An offer of employment in her field Medical Transcriptionists will not increase her chances of success because the company classified her in the wrong occupation!

Her age does limit her options of getting an offer of employment with a LMO to obtain a work permit, as well.

This lady only gets 57 points with me giving her the maximum points for English which she can not prove. How on earth did this authorized representative take this ladies money all the while knowing that she had insufficient points to be accepted is beyond me!

NEVER, EVER, PAY FOR ASSISTANCE WITHOUT RESEARCHING THE PROCESS YOURSELF! ASSESS YOUR OWN POINTS BY USING THE CIC WEB SITE "TAKE THE TEST". WHEN YOU HAVE AN OCCUPATION MAKE SURE ANYONE ASSISTING YOU SHOWS YOU CLEARLY THE NOC DEFINITION OF YOUR OCCUPATION AND GIVES YOU A COPY OF THE REAL FORMS. ALWAYS INSIST YOU MEET WITH THE ACTUAL PERSON WHO IS AUTHORIZED AND GO OVER YOUR APPLICATION (ONLY) WITH THAT PERSON PRESENT.

I´m currently stumped of what else to do, anyone here got any other ideas.

RESEARCH, RESEARCH!...DONT JUST DEPEND WITH YOUR MONEY...UNLESS YOURE HELPLESS AND BEYOND YOUR WITS...

Like you said, everyone needs to do their own research, but to be able to do this effectively, one must truly understand what one reads and must make sure they are getting information from official sources. I read a lot of questions on forums that seem to have very simple answers to me based on CIC´s instructions. I personally believe an educated individual can handle his/her own FSW application himself if the person´s situation is straightforward and if the person knows how to fill forms accurately, knows how to research and understand English clearly. I mean, it´s common knowledge that you have to fill out the whole FSW application completely and to write NA where applicable. We also know that FSW is based off of being classified in a skilled occupation, so how can someone leave an important piece of information like the NOC code off the application. Some things are complicated but some aren´t that complicated.

I agree that SW can be done with or without assistance (paid). The difference is personal motivation and organizational capabilities. I have friends who, though smart, just can´t complete anything even slightly bureaucratic. While others can accurately zip through forms and instructions without problem.

But I think it´s a mistake to assume by default or fear of the process that one HAS to find and hire a consultant. With a little inspiration, motivation, and intelligence, practically anyone can do their own SW.

But as Roy pointed out, those applications that are not straightforward due to background issues and complications might be better off seeking help.

The reason the firm left off the NOC code is that if they had put the NOC code on the copies the applicant would of seen the main duties of the wrong occupation listed.

Knowledge is power and control. Now I´m working hard to get her a position with a LMO then a WP.

How the firm individuals can look at themselves in the mirror in the morning is beyond my understanding.

The other issue is if you retain a Law Firm the employee´s are the ones that do all the work.

Some individuals are lazy and all they want to do is ask where do I sign and get on with their daily routine. Any application needs to be checked and double checked before submitting.

I think this is part of what we all know we humans are capable of doing when it comes to being greedy and selfish...
I myself completed my own application... I found it pretty simple to do... but I won´t lie... Many times I wished I had an expert to answer my many questions and to calm my fears...
I am not done yet, I haven´t got an answer... we just had the medical tests done... so far it seems like we haven´t had any major delays or mistakes ... but I guess I will not know for sure until we get our final answer...
I agree with Roy 100% though... we must first educate ourselves and at least have a clear idea about the whole process... you know... take a look at everything... write notes, find out how hard it is to get the documents needed to support your application, what is involved, how much does it cost to do all the tests and so forth... then, you can make an educated decision about what is best for you to do... hire or not to hire an attorney...
In any case... it is really sad and pathetic to know that even those that do hire experts to help them with this major process, can´t really trust that that person is doing a good job for them... it isn´t a cheap service... they should at least have the decency to do their job... I find it criminal to take advantage of people who are desperate for a chance to be in better shape or seeking a better future for their family...
There are so many stories posted about people who had been taken advantage of... it is really sad...

Dear Sir,

I am interested in applying for FSW program. I am thinking of applying on my own , without the help of an representative. is this a good idea?

I could only sent my application by First week of December, because of my delay in getting PCC and IELTS. Will this be ok?

I am also getting 67/100. but worried this is checking from one site to other..what if i get 66 when CIC calculates. will they reject it eventhough i have enough skills and experience?

Advice me in this regard. Thanks for your time and consideration.
