Subject: URGENT GURUS PLEASE ANSWER THIS
  I am tired of waiting for the USA GC. I had an approved Canadian PR card valid until 2008 March, but I got married in June 2007 and unfortunately did not get my wife added as I thought I will get my US GC. But US GC has gone out of my radar now due to delays, and I intend to migrate to Canada.

My question is:

1) Since I already have a PR card which expires in 2 months in March 2008. And I am not willing to relocate to Canada without my wife as I have not added my wife since last year when I got married.

2) What do I do now? Can I apply for a brand new PR card after March 2008 for both me and my wife?

3) Can I revoke my existing PR card? Is that possible? and can I apply for a brand new skilled worker category for both me and my wife?

I have no information when you landed. However, to meet the residency requirements you have to stay in Canada for 730 days out of 5 years. This is based on rolling time horizon.

If you got married after landing as a PR, you can move to Canada and later sponsor your spouse. This should take about 5-12 months depending on the country your wife is in.

If you got married during the application process, i.e., before landing and did not inform CIC about it, you will not be allowed to sponsor your spouse forever. Your PR status may also be revoked.

Calculate whether you met the residency requirement like Sam said.

You can apply for a new PR card, if decide to do so, then do it ASAP. They take few months to process it. Do you have the CIC required pics taken in Canada? If not, then have to Come into Canada as they don´t accept pics taken outside of Canada.

About sponsoring your wife, Sam is correct. Though to me it seems like (based on PR card expiry of March, 2008), you landed in 2003. If so, then you can sponsor your wife now (married in 2007, after your PR processing, so should be OK). But to be able so do so, you have to establish reidency in Canada as PRs can´t sponsor outside of Canada.

Thanks for your replies. But I have few more doubts, please clarify.

I already landed way back. My PR card expires in 2008 March.

Question 1): I want to stay back in USA and want to freshly apply under skilled worker category sometime this month for both me and my wife together. Can I apply with my PR card still active?

Question 2): If I am not able to apply for both me and my wife from scratch (a brand new application), then do I need to revoke my existing Canadian PR, is it possible to revoke it first and then re-apply all again and wait for 2-3 years in USA before both me and my wife get the PR and then move to Canada.

I don´t know why do you want to revoke your existing PR and re-apply. Apparently your PR status is still valid (unless lost it due to residency requirement). That is very unique. Probably you need some time to move Canada?

I know there is a way to revoke, can´t tell right now how.

Anyway, if it is still valid then you can´t apply now. Makes so sense.

You either have to revoke or or wait till to expire. In that case if I were you, then I would try to revoke it myself to avoid future inquiry/complications.

I want to revoke my existing PR which is valid until November 1, 2008 (sorry not March 2008). I want to revoke my PR and apply freshly jointly with my wife as a skilled worker again and I dont mind getting back in the queue even if it takes 2-4 years. Please let me know how do I go about this?? how do I revoke? and whats the procedure?

Also I married in 2007 June and have not added my wife to my PR nor have I informed CIC of my marriage as I live in USA. So will there be a problem if I revoke my PR and apply jointly with my wife all over again from scratch??? Please help??
