Hi,
I posted a question a few days ago, but noone replied yet,
My common law partner, who is Canadian, and I applied for my PR through in Canada spouse and common law application. From what i read in the forum, we learned that it would have been way faster to apply from home. Too bad, we didnt know about that before. Now, I was just wondering if the CIC processes my application while I´m outside Canada, I would prefer to wait for the result of the application in my country where i can work at least for a year. we need some advice. Thank you.

I have heard of people withdrawing their application and starting again for the reasons you state. How far along is your application.
the problem you now may face is that by going home, you are no longer common law.

thank you for your reply,
we just submitted the application in january 2008.
how come i can be a common law when i applied out of canada, and not when i apply in canada and leave. My partner is also planning to come with me.
I think the smarter thing to do would be maybe withdrawing the application and starting again out of canada?

the 2 things you have to remember - insuring that CIC knows that your partner (the Canadian) is in Canada as a resident.
the other thing is being very clear that your common law relationship continues - emotional, financial etc. even if you are separated.
I would absolutely withdraw the application and reapply. You might get a full refund if they have not assigned a file number as yet.
