we ran out of spots on your last thread.

there are 2 ways to begin the sponsorship process - after living common law for one year, or upon marriage.

if he comes to visit (and is granted entry) you have the options as I have listed above. I will warn you know - sponsorship while he is in Canada takes significantly longer than if he was waiting back at home and he will not be allowed to work for at least the first phase of the sponsorship application.

a lot of this information can be found on the cic.gc.ca site - look under family class.

Adding what Sharon told;

another effective alternative may be (if you prefer him to be in Canada rather than keeping him in his home country-longer way): He can manage a temporary work permit in Canada with a job offer; OR if he meets the NAFTA requirements then can come as a TN professional then you can sponsor him. So that he can work in Canada while the process is on going. Still the time line will be longer than if he applies back home.

HOW DO THEY KNOW IF HES LIVING HERE OR NOT? ANYWAYS WHEN HE DOES MARRY ME IS HE PERMITTED TO STAY LONGER? IF NOT THEN HES JUST GOING TO VISIT ME A FEW TIMES CUZ HE CANT STAY HERE FOR 6MTHS THEN GO BACK TO STATES, ITS A WASTE OF TIME FOR HIM AND HES WORKING THERE NOW, HE DOESNT WANT TO LOOSE HIS JOB THERE IF HE CANT GET ONE HERE AND CANT STAY.

I KNOW ABOUT THE WORK PERMIT, BUT HOW HE GOING TO HAVE A JOB OFFER? FROM WHO AND WHERE? I RATHER HIM WORK IN HIS STATE THAN GO THRU MORE PAPER WORK AND STRESS!

By the theory unless anybody reports, he can stay with you ILLEGALLY after the granted period of time as a tourist. Unelss you sponsor him and he comes as a PR he won´t have any special consideration to be granted longer periord to stay, no matter you marry him or not.

Now, Illegal is illegal. I think you know the consequences, it is unethical, not allowed to work, no medical...life is miserable in short.

For work permit I believe he needs a job offer 1st approved by the HRDC. Don´t know much.

Other than the waiting time, spousal immigration is very easy if genuine. You even wouldn´t need any attorney if have no special complicacy. Waiting time is also not much relative to other immigration class. US spousal immigration is even longer.

This is the only ultimate way if you want him to be in Canada with a permanant status.

IM GETTING A LAWYER BECAUSE I SEE ALOT OF PEOPLE DO MISTAKES IN THEIR APPLICATIONS AND I DONT WANT THAT TO HAPPEN AND WILL GET GUIDE FROM LAWYER IF ANYTHING IS INCORRECT OR MISSING OR NEEDED. PLUS MORE ADVICE FOR ANYTHING.

something I learned the hard way - each of us here have an idea how immigration should work. Those who are in love are particularly frustrated that they simply can´t fall in love, cross the border and live happily ever after.

It ain´t going to ever happen that way. The sooner you let go of all your preconceived ideas about what should happen and how... you will be far less stressed.

Marriage entitles your guy absolutely nothing. The pros and cons of inland, outland, jobs etc. are a very personal decision that you and he will have to make.

Sounds like you are leaning towards him staying in the US, continuing his job until everything is finalized. Probably a wise plan. That does not preclude either of you from travelling back and forth for visits. People in the immigration process do it all the time.

the only down side is it forces a marriage rather than common law and for some that is more government interference in their lives than they want... but get used to it - when it comes to immigration, your relationship is up for full scrutiny.

Make sure you keep every phone bill, love letter, plane ticket, chat log if you have them. Family Class immigration is reverse onus. CIC says no until you prove to them that they should say yes to your application. Relationships must be proved as genuine and enduring. Marriage certificates or babies are not enough.

If you decide to go with an attorney that´s why. Of course that would keep you on the safe side. I just told based on the experience of most people. Then you also don´t need to ask questions here, your attorney should answer and provide you the best way.

I just like to say; looks like you are new into the immigration world. Immigration is very complicative & lenghty process. No next day service here.

Would you believe that if you aren´t an US citizen just a GC holder and would like to sponsor your spouse then it takes upto 3.5 years? Canadian spousal immigration is way faster than that.

ya sorry for the caps but there was more than 1 person here, so i wanted myself to be noticed cuz theres no color changes in the fonts.
and ya i will be visited from him every 3 mths cuz of his job. but we were talking about marriage even before this came up so its not interferance for us.
