Subject: Relative is currently residing
  Dear All,

I have applied as a skilled worker from Buffalo, NY in June,2007. In my application, I claimed that I have family in Canada, because at that time my brother who is a Canadian citizen used to live in Canada. The problem is that my brother has left Canada since he got a better offer outside.
Recently I received a letter from the immigration asking for updated documents. One of these documents is to provide an evidence demonstrating that your listed relative is currently residing in Canada.
The first question, do you think is it normal to ask for such an evidence, or do you think they have a doubt or they knew in away that my brother is not residing in Canada right now.
The second question, my brother still has health insurance and his driver license. Are these evidence enough? if not then what kind of documents I need to provide.

if you claimed the 5 points, and you need them - then yes!

how about a property tax bill or a lease or a rental agreement. residency is the 5 point question.

The idea is that he is around to assist you in settlement and adaptation. If he is not around then you can´t claim the points. Pretty straight forward.

Would you please clarify more. I am depending a lot on these 5 points and i don´t want to loose them. Still I am confused, so please let me know what you recommend based on your experience. As I told you he still has his health insurance, but I am not sure about if it´s considered as a valid evidence.

Healthcard/Drivers license don´t necessarily mean that he is in Canada to assist you.

He needs to be in Canada to assist you otherwise no point of favoring you extra 5 points.

If he can proof that he is in overseas TEMPORARILY then it may work. To be able to do so, he needs to pay the tax Canada as a resident. Usually overseas canadians (working like him) can pay tax as non-resident. If he files his tax as a non-resident then forget about the extra 5 points.

Also, house lease/property docs...can help.

Hi, I had to submit relatives bank statement, tax?papers and credit papers. If some has apparment/house those documents they don´t count that your relatives is in Canada. It happened to me.

Thanks guys for your replies. Based on what Departed_Canadian said it seems I will not be eligible to get these 5 points. I guess because of his tax filing they will be able to track and see if he is really residing in Canada or not.
