Subject: returning to canada (plz help )
I did landing since 17 april 2003 for 4-weeks then i leave canada to work in the gulf ;i didn´t retun to canada since that time but still my pr residency valid until 16 april 2008.

The question is can i return to canada or not ;plz help.

Dear Salim,

May be a big bad news for you. What your heard from "somebody" was almost 100% correct. That is within the ABC of the keeping PR status. I don´t know how anybody can miss that. 2/5 years rule is the deciding one. According to that one, you already lost your PR status (within this 5 years you only stayed 4 weeks in canada, correct?) unless you are within the following class:

1. Working in a Canadian company overseas.
2. Accompanying your Candian citizen spouse/children.
3. Accompanying your PR spouse who is maintaining the 2/5 years rule.

If you lose your PR status then can apply for Humanitarian Ground to regain.

You may retun to Canada if the immigration officer at the airport doesn´t question you a lot and you lie there. BUT, when you´ll apply for PR card renewal then they´ll deny you based on the information your gave.

So, please plan accordingly.

Just to add, if it is determined at the port of entry that you have lost your permanent resident status, you will be allowed to enter Canada to attend loss of status hearing.

As for your status, if you cannot prove that you stayed in Canada for 730 days out of previous 5 years, you will lose your permanent resident status.

I found a interesting thing about PR card from CIC page

"Do I require a Permanent Resident Card if I?m returning to Canada by car?"

"The Permanent Resident Card is required to re-enter Canada by commercial carrier (airplane, boat, train or bus) only. This requirement does not apply if you are travelling by car."

BUT:::

Why did Citizenship and Immigration Canada introduce the Permanent Resident Card?

Citizenship and Immigration Canada introduced the Permanent Resident card to:

increase border security
improve the integrity of the immigration process and
provide holders with secure proof of their permanent residence status when re-entering Canada on a commercial carrier (plane, train, boat and bus).

How does travelling by car make a difference??

Canada was forced by the US government to introduce PR cards because of all the 9/11 terrorist that came through Canada. If you have an IMM 1000 that is sufficient document to establish that you should be "considered" as a PR of Canada.

Tariq,

I know the CIC requirements for PR card.

The major issue is not the PR card.

More important issue is whether that guy lost his PR status. Apparently based on what he said I assume it was lost long back. He now only can enter appeal. If I were him I would be looking for a good attorney/consultant with good history of such wins.

Though we don´t know how much it matters to him.

Dear Tariq & Salim,

Plesae help me out - I assume you went thru your PR renewal since the expiry you mentioned is April 16, 2008.

Please guide me as I am currently preparing my travel to Canada for PR renewal.

from the day you initially landed you needed to be living in Canada for 2 years out of 5. If you are coming back to Canada to renew and have not been residing in Canada any of the time you have been a PR - you have a serious problem´.
