Subject: sponsoring US husband questions
  hi,
i am a canadian student studying in the US, and my husband is a US citizen who´s just recently got his BA. In order for us to continue our relationship when i go back to finish my studies, we recently got married. we were planning on doing it spring ´09, but my financial situation changed and i can no longer afford international tuition fees. we dont live together but we do have joint banking accounts, records of emails, pictures of our civil ceremony & celebration, etc.

we are currently looking through paperwork, and is wondering if anyone had suggestions on how to get him into the country as quickly and smoothly as possible.
is it best if he stays in the US and applies to the buffalo embassy? could he come with me on some kind of temporary visa while the application is processing? is it difficult for americans to get a PR? would we face a lot of scrutiny regarding our marriage, since we havent been married that long? would hiring a representative be beneficial?

i know its a lot of questions, and i´d really appreciate any input or information on any of this.

Others will tell you to do it yourself which is possible but submit everything to Mississauga CPC to get yourself approved then pick Buffalo RPC. Its alot faster!

You will have to return first before he gets Landed. Income is not an issue but I hope you paid your Canadian Income Tax or do so now regardless of Income or lack there of.

Why did you get married?

So you want to be with him and you want to be with him quick! Sounds like a loving passionate situation or is it just....

Anything we do with our five senses we interpret so when being Judged we have to be careful how we portray our own situation. So far some of your motives could be called into question then if he is kicked for an interview processing times increase.

So since you´re both just finishing University this was probably both of your´s first marriages, correct? Did yours and his parents attend the wedding? Have both you guys met the various In Laws?

I suggest you get your application in ASAP with all the required documentation including the non-numbered question at the bottom of both questionnaires. Be sure to make both of your answers at least one page in lenght

Well you might want to play house during the time it takes to process your application. If your husband arrives at the POE prior to you being approved as a sponsor he could be granted entry based on how he responds to the questions.

Purpose for coming to Canada? Going to party in Toronto with one of my friends I attended Harvard with. Not going to live with my wife! If he arrives with his dog/cat and all of his pots and pans he will not get in.

If he is already in Canada make sure that his residential address on his schedule 1 and all other forms are US based. He would only be a visitor here, correct.

Spousal sponsorship is usually the most straight forward immigration case.

First of all, you don´t need any income to sponsor him.

You can apply for his PR while in the US, though you´ll need to establish your residency back in Canada after he gets his PR.

As an US citizen he should be always welcome into Canada as a tourists and stay for few months (assuming no criminal offence), though won´t be eligible for work or any social care. By that time if he can have a temporary work permit if can manage an approved job or if qualified can work under NAFTA. Sometimes if an immigration application is on process his aceess into Canada may be denied (I would say it´ll be rare for him as a visa waived tourist).

Hire a consultant or not depends on how complex your case, how confortable you are in the paper works, how much can you spend...like questions.

Whether you hire or not; fisr read all of the rules/regulations by yourself and have an idea. They are written very clearly.

the problem with sponsorship cases is they are not black and white - so in that way they are extremely complicated - why? they are subjective.

a skilled worker app gathers up the ´evidence of employment and education´. test is only whether the documents are legitimate.

Sponsorship apps are clouded by the delusion that we love each other and that should be the end of it.

CIC assumes you are lying until you prove you are not. the documents and story you present are far easier to fabricate. Therefore, you must present your application with the mind of a lawyer before a judge.

I am not saying you must hire someone to do it for you, but I am encouraging you to set aside the warm and fuzzies and treat this like a university assignment. Build your case. the un-numbered questions are the most critical and should not be glossed over.

wedding pictures are far less compelling than photos with friends on the back patio.

I read an article the other day where CIC turned up 42 applications with wedding pictures taken with the identical guests at the identical venue. Anything can be done for a price and sadly, people have really spoiled it for the honest amongst us.

Hi Sharon,

Marnelle here again. im kinda worried with what u have stated above that that CIC turned up 42 applications with wedding pictures taken with the identical guests at the identical venue. What does this mean? im worried because all those real marriages will be compromised or those couples having real relationship and marriage will be the one to suffer just because of so many fake marriages now adays. :-(

well we were getting married anyway, but simply moved up the date so that we could apply for the spousal sponsorship. I was supposed to transfer back after another 2 yrs here in the states, which would´ve given us plenty of time for this, but my tuition funding fell through.
the rushing of this sounds does make it sound a bit weird, but i have to return to canada in time for the fall semester. for obvious reasons, neither of us want to go weeks without seeing each other. we dont officially live together (no lease was signed), but we´re used to living with each other like any husband and wife.
i dont keep in contact with my parents, but im close with his family and friends. we had a civil ceremony only (where his mom was the witness), but did celebrate with a dinner with our friends and his family.
we´re filling out all this paperwork now and, based upon what ive read, going to submit it to the buffalo consulate. we know that he´s going to have to stay in the US for a bit after i leave this august, but i just wanted to know if there was any thing we could do to shorten the time we have to spend apart.
