Subject: FBI background check question
  Hi folks,
I submitted a skilled worker application to Canada last year from the United States. I entered the USA 8 years ago legally. I got arrested by the US immigration for not registering with them after 9-11 when I applied for the greencard. Unfortunately the greencard was never approved and I have been in a pending status fighting the US immigration decision in court. Last week when I got the FBI background check for my Canadian application it had that immigration arrest from 5 years ago. My question is would the Canadian immigration officers care about that arrest and deny my application or they don?t care about applicants immigration status/issues in the US?

My guess is that Canada immigration is more interested in any common criminality records than a one-time violation of a foreign registration rule. I would continue with the application.

Hello Sam,
I am not sure if my reply will help but my husband was in a similar position as yours... he was arrested for an immigration violation in the US (overstaying illegally)... after his arrest he was ordered to leave the country... so we all did...
We requested our FBI background checks and on his it shows the arrest and a brief explanation of the reason for the arrest is given (immigration overstay)... we sent the police reports with our application almost 3 yrs ago... recently we had just being asked to get the medical tests done and to send the RPRF ... we did...
We have gotten this far... but I am not sure what will happen next...

I´ve heard that it is also at this point when CIC checks the police reports and does the background checks so I am not sure what it is they do exactly... also, someone else once told me that when it comes to immigration violations the CIC is not so strict because they are aware of people trying to find a place to settle... and therefore having immigration issues sometimes... but I am not 100% sure of the views of the CIC officers with this regard...
I am in the same boat as you are... perhaps someone else could give us peace of mind with another post explaining more about this topic...

Submitt a documentry proof of your immigration matter in US courts along with FBI report, so that they could understand what happened before assuming any thing else. Whenever there is an issue one needs to communite properly. Write an explanation why there is an arrest sated on your report and why you could not register with INS when they started registration process. And attach any available proof. I am hopeful if you could address it properly, there wont be any problem.

my case was even worse,i left usa with the immigration warrant and seek asylum in canada with different name but proper identity. when they screen my fingerprint, eventually the immigration found out who i was and where i have been and had therefore my background record.they found out that i had ice warrant and dismissed domestic violence. i was called in by the canadian service of border agency to discuss about my eligibility o remain in canadian soil. the border service agent told me that my ice warrant was not a criminal matter and my domestic violence was dismissed and is over 6 years. my asylu case was reopen for the hearing.
