Subject: Spouse sponsorship/work permit while temp resident
  Hi,
I am a Canadian citizen and my spouse is Bahamian. He does not need a visa to enter Canada and can stay for up to 6 months.

My questions are, when we try to relocate to Canada:

1. Can we both enter on a one way ticket? If not, if his had a return date of say 5 months down the line is this ok?

2. Can we apply for his PR and work permit simultaneously as soon as soon as we land in Canada? While he is just on his passport?

3. Does he have to have a job before he can apply for his WP considering my citizenship. Alternatively how does the OPW work?

4. If the 6 months expire before his WP is approved how does he apply for extension and what kind of extension.

OK, deep breath.

1. he will need a return ticket to leave Canada. be prepared for a bit of a challenge if they realize the two of you are married. They will assume he has no intention to leave at the end of his visit.

2. you will need to sponsor him. it is a 2 phase application. he applies for an open work permit at the same time you submit all your sponsorship documents. Once you are approved (as the Canadian) they will allow him to work. This could take 6-8 months.

3. He has no authorization to work in Canada until #2 is past the first phase and they issue a work permit.

4. you must begin your sponsorship application before the six months is up. once you have done that his status can continue legally.

5. you may wish to consider an out of Canada application. it will mean you are separated but the process goes much faster, you have the option for appeal and nobody is forbidden from working.
