Subject: U.S. Citizen to Canada - TN Visa
  I´m sure this question has come up many´a time. But not specifically matched my situation.

I am form the U.S. , I have a job offer with a company in Montreal. I have 4 years of experience in the field. As well as a 4 year degree. My profession is covered under NAFTA.

I want to know more about the TN Visas. I have read that each time you apply for the visa, you have to convince the official that you plan to leave once the visa has expired, is this true? And if you are in Canada on a TN visa, can you have access to their health care system?

And, most importantly, my girlfriend of 2 years will be accompanying me. I have read about Canada recognizing "de facto spouses" and "common law partners" in which you reside with the other person for a period of over one year. How can she easily come with me without use rushing to the alter to get married.

I was on the opposite side; Canadian went to US on TN. I may give you some info though may not be equally true for the Canadian side.

In short, TN is not hard, if your job offer is relavant to your degree/experience. MUST be temporary, job assignment can´t be more than 1 year. This must be clearly written in the TN letter.

Yes, this is what I keep reading. But then I hear about people who are working in Canada, and have been doing so for 3 years or more on the same VISA status, just renewed each year.

I don´t have an issue with going for a more traditional work permit. I am just weighing all of the options.

TN doesn´t have any upper cap. Theoretically you can extend that every year...no limit. Though in reality if you extend it for the same company for 4/5 years then the issuing officers may give you trouble. It is totally upto his/her decision, greatly varies from person to person.

For the extension, it is better to do it by mail other than facing the interview face to face. Though for the 1st time you must have to appear in person for the interview at the port of entry.

I have seen many Canadians in the US on TN status, and I think that figure will be more than Americans in Canada on TN status, and they have been successfully extending their TN status year after year by mail without any issue.
But with the latest furore on NAFTA not sure it abodes very well for the future, but hey, in a couple of years the economy will pick up, and everyone will forget about it and be happy !!
