Subject: Visitor Visa Refusal
  Hi everyone,

We applied to sponsor my father 2 years ago. 6 months ago we decided to invite him here to visit us. we send him a notarized letter promising to pay for all his expenses. We asked him to apply for multiple entry visa, because it is hard for him to travel few times, 600 km to the capital and line up for different reasons. six weeks after applying they told him to go to the embassy for the visa. he travelled again just to receive medical forms ( they could have mailed it to him). he did medical and after two months and trying to get an answer finally they told him again to go for the visa. this time they handed him a refusal letter mentioning several other reasons. All the refusal reasons were known and declared to the embassy from begining. why he was sent to medical and waited to get the result and then be refused.

we are thinking to go to federal court.we appreciate any suggetion.

what is there to go to the federal court about?

either they are medically inadmissable, or there is concern they will not go home. In either case, CIC is doing their job.

Well, going to Federal Court will give you NOTHING because CIC has the right to refuse the visa for anybody for any reason. Federal Court will not even accept your application for such complaints, trust me on this. Sharon is right, your dad must medically inadmissable or may be there is any other reason that convinced them to say no for his visa. You may appeal the decision in the same consulate but goin to federal court is nonsense, and nobody would ever recommend. If he is medically inadmissable then no matter what you do, he can not get the visa. If there is any other reason, you may look into that, find a solution for that and re-apply.

if you really want to spend some time with your father you many need to consider a plane ticket for you and your family. That is a cheaper option than paying for lawyers to appeal something that likely cannot even be brought before the courts.

thanks for your replies. first thing is that my father passed the medical exam. so he is not inadmissable and that is why it is not mentioned in the refusal letter. the officer waited for the result of medical and almost 4 months after submitting the application refused the Visitor Visa based on unfair reasons such as Professional situation which was known to them from the first day. My father is a retired teacher and 79 years old. where in the world anybody expect a man at that age to be working. They mentioned his financial situation where he showed properties title, pension salary and our commitment as well-established canadian to provide all the expenses. beside he has a good history of travelling to canada and europe known to the embassy.

It is ourageous that they tried other ways to see if he fails in his application but when he passed the test they metioned his proffesion which he can not do anything about that.

if they wanted to refuse him they should have done it in a first place and not giving us hopes and hardship.

Sharon, thanks for giving me the option to go to visit him. unfortunately that is dangerous and not possible for me. Beside I have 2 small kids (one infant) and a wife that never seen him before. My mother-in-law, being from eastern europe, gets 5 years visa processed in five bussiness days without going to the embassy.

This is a simple visa not immigration.so we are not talking about rights or previlege here. I belive my sons have the Right to see thier grand father. what should i tell them when they are bigger that they could not see thier grand father because they did not let him come.

I´ve consulted a lawyer and after seeing the refusal letter and explaining the process he said there is a lot of chances because he doubt the officer procedural fairness and he would ask for a "leave".

we cannot change his age, professional,or financial situation. so there is no point to reapply again.

one more thing,

my father paid for a multiple entry visa. If the processing for single or multiple entry visas are the same, once refused, why a differential refund was not issued.

actually, visiting is a privilege too.

something is missing in your information - something that is making the CIC officer suspect Dad is not going to go home at the end of his visit. no family ties there? not sure what it is but it is something.

As far as your sons having the right to see their grandfather - you are absolutely right and as cold as it might sound, CIC will tell you to arrange your plane tickets so that your sons can meet their grandfather.

Unfortunately, people before you have spoiled it for those who are honest in their intents.

I was applied for canadian visa for tourist with relevent documents, but they deney they ask i will not back to my own country.

These guys did the same thing to sme. I was only going on holiday for a week. I had a return flight to UK a hotel booking confirmation for throughout my stay and $1000CAD in cash. I was so upset I burst out crying! The guy asked me for phone numbers for my sis and grandad who they said they were going to check if they knew when my return was. The phone alls were never even made! Also the guy helped himself on my Facebook and told me "you have financial problems". Well I even offered to show him my online bank account which I have £23,000. The guy declines. This and then some other immigration girl shouts "shut up you not getting in Canada today" in politest way possible I told her to "shut up yourself and keep your nose out" then she threatened to arrest me so by now I was so upset and frustrated I shouted " I don´t care you have ruined my holiday" she and colleagues jump on me arrest me drag me up like a rag doll n inform me I´m going to jail. I don´t have any criminal convictions here in UK and have a good character so this was so distressing for me.when I arrived there I was locked inside a dirty cell for 17 hours crying until the immigration came to collect me at 2pm the following day. The women who came to collect me were not that bad but them other animals from the night before treated me like a piece of dirt and I am not going to let these monsters get away with what they did to me. I have photographs of the injuries they did and also all documentation of my flight, hotel booking and what he read on my Facebook. I have been to US 5 times and never had this sort of thing happen. I thought I would try Canada for a change but never again. I don´t want to travel no more because of what happened to me. I´m just glad to be back here in UK now. I feel safe once again! I will not rest until these people are punished for what they did to me. It´s a horrible way to treat visitors to your country and I certainly hope UK border agency do not act in such a manner toward visitors coming here!
