Subject: am i a criminal?
I am an international student studing in vancouver. 1 year after i came here, i was caught shop lifting at Save on Foods. I was caught by the internal security. They took a picture of me and barred me from entering and Food store in Canada. Although the RCMP was NOT called in, the internal security of Save on Food made a phone call to the RCMP in front of me and reported the incident to them.

does this mean that i now have a criminal record? will it affect my future applications for canadian Visas or Permanent Residency?

please advice.

Thank you!

if you were not brought before a court - probably not however there will be a file in the RCMP office with your name on it and your activity will be there for the judge to look at should you do it again.

Not a very smart thing to do.

come on buddy, that was not a smart thing to do, however, you may go back and speak to the manager of the store and asked them if they have pressed the charges against you. I strongly belive that they haven´t otherwise they would have arrested you. They gave you a warning and asked you not to enter the store. Because if they press the charges they would have to appear in the court as well with you to pursue their allegation. I think you are clean and you must not do this kind of stuff again as it can ruin your future. To get more clear picture, speak to the manager but i am very sure that you are clean. They called RCMP to get an advice may be and make you scare as well. Otherwise if they press the charges RCMP would defintely come and arrest you on the spot. But this never happened. So you are clean.

if he filed a report he has the option not to press charges. It is not uncommon for the RCMP to compile a file listing complaints which will assist later when a charge is considered.

Do not assume that None is free and clear with the RCMP.

i know this was not the smartest thing to do.. i usually dont do these kinds of stuffs. in fact, this is the first time i got into trouble with the law... ever! i dunno wat was going on in my mind that day... i definitely regret it. i just dont want this silly mistake to affect my application for PR (which is already in process).

the internal security did mention that they had the right to press charges (up to $5000). however, they said they wont. but they did make the phone call to the RCMP and reported the incident. they gave the description of the object stolen (a small pad lock worth $5) and my name, address)

all i want to know is that if this will be the reason for my PR rejection.

i shall call the manager of the store and ask her tmr!

I would leave it alone. You will find out soon enough when you provide your police clearance if it is showing up. I suspect everything will be OK.

GOOD NEWS GUYS!! (in reply to: am i a criminal?)
Well, I spoke to the internal security today. He says that the phone call made to the RCMP was just to check if that was my first offence. My record was clean, and is presently clean as well!!

woooohooooo... i am so glad! hopefully i will get my PR some time soon in the near future!

god bless.
