Subject: Canadian wants to Marry a Japanese woman
  I am a Canadian citizen living in BC and my girlfriend (who is Japanese and here on a working holiday visa) are currently living together.
We wish to get married and she wishes to stay in Canada and work here.

We have a couple of questions
1. Is there are rules or documents we required for us to get married or can we simply get married?
2. When we are married can she stay in Canada and live with me until I apply to sponsor her to stay here.
3. She plans to go back to Japan for a month to arrange things to stay in Canada. Can she apply for a visitor visa to come back so we can get married?

1)not from an immigration stand point.
2)she can, but be warned, the application process is longer than if she were in Japan and she could not work until the 1st phase of your sponsorship app is approved.
3)CIC is not keep on allowing people to wait out their immigration process in Canada when there is a chance they may need to spend money and resources to deport at a later date if the outcome is negative.

in her visa Application she will have to show intent to return to Japan after her visit - how will she do that if she is closing up her life to permanently move to Canada?

Thank you for the information. We both dont have any experience in this process and its all new to us.

So it sounds like we could get married then she goes back to Japan while I start the process to sponsor her as her husband to come here.

How long does this process take? I hear about 1 year.?
Would it be possible to talk to you in person about this?
If it is, what is the fee you charge for this?

we all offer our advice here for free and are happy to do so.

the fastest and least complicated way for a sponsorship application is an out of Canada. see www.cic.gc.ca and look up family class applications.

Hey, I am dealing with Canadian immigration services from the past 3 years now. Me and my wife applied from within Canada and after TWO years of waiting I was refused permanent residence. Anyways your experince could be different, but I sure thought it took a long time and the call center was not much help either.

one of the pitfalls of inland applications is there is no option for appeal. kj is living that reality, I am sure. The entire process takes longer as well.

while the notion of living apart may be difficult, the pragmatic realities may sway you to strongly consider an out of Canada application - I know I would.

Thanks for all the information.

It sure seems the easiest route is to get married, then she stays in Japan while I sponsor her here from Canada
This seems only to take 6 months

Hello,

I just read your post and I hope everything works out for you! I was wondering if anyone in here could help me out? I am working in Japan and I came here to marry my girlfriend. Recently though we just found out she is two months pregnant and we will have the baby here in Japan. What would be the best thing to do to apply for the Canadian Citizenship? I dont want to really seperate from my gf and our new baby for a long period of time. Anyways if anyone could help me out I would really appreciate it, ie how long it will take it you apply out of country and all that information. thanks

Craig, first thing... congratulations.

If you are a Canadian Citizen (different than a PR) you are eligible to sponsor your wife from outside the country. You will be required to show your intent to move back to Canada. The process is 2 stage - first they approve you as the sponsor (takes about 2 months) and then they will look at your partner. If you have not been living common law for a year, I would get that marriage thing happening. It´s and either or for CIC. No fiance options.

The second phase of the application can go reasonably quick. 4-6 months after phase 1 approval. It all depends on how busy the embassy is, how her documents are prepared etc. You could expect to be in Canada about a year from now
