Subject: Spouse Vistor Visa
  I got married in January 2008 and my husband holds PR in canada. and I applied for tourist visa to canada as a single sfter the marriage which got rejected on the grounds of financial instability and unemployment. Now, my husband planning to file a sponsorship and immigration as he is in canada. Will this pose a problem in my sponsorship file processing.


If yes? then Please suggest me how should I go for it.

That depends.

When you applied as a toursit and rejected; did you disclose at that time that you are married to a PR?

If you didn´t tell that then it may be a problem.

If you were honest at that time then I don´t think that it should be any big deal.

Hi anjali, if you were honest while filling out that tourist visa form and in the interview then actually it will help you then giving negative impact. coz it shows you guys didn´t wanted to get seperated so applied for tourist visa but got rejected. and tourist visa has no relation with PR VISA one is for coming back and other is for NOT coming back. so there will be no problem. good luck to you and for me too. i am waiting for response from New Delhi. my file just got transferred to NEW Delhi.

I showed them i am single. but I was married.

will it be a problem for family class immigrtion.

and did you filed ur immigrtion when, where and did u have any representative.

Anish, Anjali - this is actually serious.

Anjali LIED to the Canadian government about her marital status. The technical term is misrepresentation.

I really don´t know what to suggest about how to fix it. That TV application will show on Anajli´s records and the date will be required for her marriage and all the supporting documents that say the marriage is genuine.

Saying you lied because you don´t want to be apart is not an acceptable excuse.

Anjali, yeah sharon is right, that´s a serious case. i am not trying to make you scare coz of misrepresentation but trying to aware you. Never try to lie or make it bigger then what you have and who you are with immigration. Your marriage is genuine and legal. you r good couple and why to lie??? One of my friend had similar case, he got PR VISA as a dependent and after getting visa he got married. he came to canada leaving his newly married wife there and at the port of entry he lied immigration officer that he is still single thinking that i/o won´t let him enter as he came under dependent class. after coming here he applied for his spouse and got rejected as the date of marrige was earlier then he was recorded on PR as single.
well, that has already happened so now forget it. Do what ever way you can, to convince cic that it was not misrepresentation. i would take suggestion from experts. what date does your marriage certificate shows? coz i have seen some ppls in india gets married one day and they have marriage certificate of other day.

I used Representive as i was really worried, and thought its faster but it doesn´t worth it. in straight case rep is not really required. I filled on the last week of feb from CPC-Missisauga, If your husband is PR u cann´t fill from india. he needs to be in canada for sponsorship. later after the approval of sponsorship while waiting for visa at Delhi embassy he can go back to india.
don´t know if it helps to you, where does your husband lives in canada?

Thanks everyone.

He is in toronto. So wht u suggest is I should take an advise from proff or should i go ahead and get sposorship and apply for immigration and then later in interview i can explian them the situtaion

I would say, If you think that you can convince then go ahead and apply, coz in spouse case they cannot reject any visa without interview. they will either not take interview and give visa or take interview.

what if we get married again in court and use this new marriage certificate . we should use this current marriage certificate for application. In that case then there will be no question of Mispresentation.( as single )

One lie to overcome another lie hmmmmm so you were married before and your now going to deny that on your spousal sponsorship forms..........hmmmmmm

When I get to the office I´ll have to read all the postings on this one---this is a mess I think.

So R U a little pregnant or R U a little married hmmmmmmm
