Subject: Tuesday's Parliamentary Vote
  Will the new Immigration Legislation be rammed through this coming Tuesday on the backs of a budget bill?

Will the Liberals stand up and be counted?

This Immigration legislation gives the Minister of Immigration "God Like Powers" and is sooooo undemocratic but few anywhere seem to care. WHY, WHY, WHY?

HERE IS MY EXAMPLE OF THE PROPOSED LEGISLATION;

Lets say Tom and Bob applied from Country "A"

Tom applied five years ago and has been waiting for his turn.
Bob applied less then one year ago.

Tom has been asked to pay RPRF, done his medicals, security clearances, provided evidence of settlement funds, PACKED HIS SUITCASES and goes to pick up his passports after stamping is complete.

New Visa Post employee sees that Bob´s occupation is in high demand during initial screening.

Tom arrives to pick up stamped passport and receives back his passport with no stamp in it! Tom asks were is my (COPR Visa Stamp) and is told no decision is made. Tom says what does "no decision mean" and is told just that you have not been refused and you have not been approved its just at this time no decision is made! Tom says I wait five years and everything is complete and now my file is back to IN PROCESS, the Canadian government has taken my money and made me wait five years and now I´m not even elligble for a refund! NO DECISION MADE

Bob gets called in the following week to present his passport for stamping.

Bob could of applied for a work permit.

THIS OPENS UP ALL KINDS OF SCENARIO´S FOR POTENTIAL DEVASTATION BY MONEY HUNGRY INDIVIDUALS WORKING IN CANADIAN VISA POSTS. THIS OPENS UP ALL CANADIAN CITIZENS TO RIDICULE YET EVEN FUTURE IMMIGRANTS DO NO SEEM TO CARE! WHY?

Regulation 11 was considered necessary when some representatives would submit their Hong Kong clients FSW applications in Havana instead of Hong Kong and after pre screening if called for an interview transfer the file back to Hong Kong to get their client ahead of the line.

Regulation 11 was implemented to prevent applicants from hunting for the Visa Office with the best processing times and in theory allow all to be treated fairly. It was to make everything more efficient yet processing times have increased by 600%

There was no grounds for Regulation 11 and there are no grounds for this legislation. If it was important to take your turn for every other government why not the Harper government?

TO MUCH POWER CORRUPTS THIS SHOULD BE STOPPED!

Roy, I do care about the impending immigration legislation and the possible negative consequences. I´m typically the example that you used - have waited for 29 months and did medicals recently. Now a possibility I might never get passport request! Utterly frustrating but as a foreign citizen, I cannot say anything about Canadian policies. Can only hope for fairness and generosity.

As per my understanding, the situation you conceived is not possible. The amendments proposed only say that CIC may pick up an application for processing whenever it likes and is not obliged to follow the order of applications received. But if an applicant has been asked for medicals, it means his application has already been processed and he was found to be qualified to immigrate to canada. After that, there should be no "going back".

The proposed amendments will apply only for applications after Feb 27, 2008. You don´t have to worry - you will be processed as per old rules.

Hobbes and you believe that the sun will shine everyday and it will never rain. I like to think that too but we are talking about promises of politicians!!!!

Google this "Dragan vs MCI" in the Federal court or google transitional provisions. The last time the politicians amended the act they did not care about all the people who had already applied under one system of points and now would be assessed under another system with different rules. The Federal court had to order CIC to assess the clients already submitted under either act/regulations which ever was most beneficial to them.

Denise Codere did that a Liberal whos party has always climbed in bed with ethnic voters. He also stopped the processing of parental sponsorships and told no applicant or counsel.

The legislations states that at any time they can select others who the Minister or his/her delegates choose and not render a decision on a file in progress that means the file that the person has applied for stays in limbo with no negative or positive decision.

Money paid and never given a result.

A: The new measures will apply to applications received on or after Feb. 27, 2008. Those who applied before then will be dealt with under existing rules, the department says. That means those already in the pipeline likely face long delays.

Would you enter a race from point "A" to point "B" that must follow a certain route pay $550.00 to enter and never be told the route?

When a government employee who wants to get promoted knows that he/she should be focusing only on certain types of applications like high occupational type applications.

Do you really think if the Boss does not care about a H&C or a Chemical Engineer FSW applicant who has applied four years ago over a Carpenter that applied last week. When an employee wants to get brownie points they will focus on the work the boss tells them to focus on and the others will be given NO DECISION status.

The rules/regulations as to the how to, will come out in the Gazette after the legislation is passed----WOW THATS FAIR, just not the Canadian way.

do not worry guys, nothing is going to happen to people who have been waiting on their applications. Hopefully, this will be for new applicants and it will also clear the backlog if applied to applications already filed. You will receive passport requests. Be positive.
