Subject: Family Class Sponsorship confusion
  Hello,

My boyfriend (common-law husband) and I are starting the sponsorship immigration process, and no matter how much I read the CIC website I am still confused on a few matters.

1) My partner had a son whom he does not live with from a previous marriage. The custody issue wasn´t established through lawyers, but it is understood that the mother has sole custody. Is this child still a dependant for immigration purposes? He contributes a small child support payment every month.

2) He is currently living in Canada working on a Working Holiday Visa. We cannot apply until May because that is when our year of co-habitation is finished, but that is also when his visa runs out. What is the best way to apply for a work permit in this case? Is it better to try extend his stay seperately from the resident application? We are young and certainly not rich, so how do we stay together and both employed during this long process? His employers have agreed to complete a Labor Market Opinion to try and keep him here, but the processing times are 3+ months. Any ideas?

I would appreciate any responses, trying to figure out the government has me hitting my head against a wall. Thanks in advance.

1) yes, even if the child is not in his custody and will not come to Canada with him - CIC asks that they be included and medically examined. (god knows why)
