Hi there, thanks very much for the advice and help you guys have given. I have a bit of a family delema. It starts out like this.I have two dependant child living in jamaica, there mom and I are not together zny more and she has asked me to take my kids and to jsut leave her alone. I have started the sponsership application for both of them but only to be refused one of them as according to immigration I had excluded him from the family class at the time of my application.
My son is 15 years old, and he is really sad, so far the other child papers are fine and they are going through. Now what do I do with my 15 year old son. He was born 2 months before I landed in canada, I honestly did not know that it was a must that I had him he was just a baby. I am confused and dont know what to do. I have decided to appeal and have send off teh papers for that, now they have replied asking for documentations for the case. I dont know what to do thats my son. I will do anything to prove he is.
What do I do, should I cancel the appeal or give it a try
WHat sort of documentations are they looking for
and are there any other ways for me to sponser my son, I had one child murdered in 03 and I cant let this happen again, help

If its a DNA test that they are looking fro to prove my relationship to the child am willing to do anything.I agree they are costly but am ready I need my child. Do u think that they will ask for dna

Hi sharon, your the only one who have answered me so far am gald for yoru answer, DNA eeh well if that teh case that is the lease, its just that they are saying I excluded him from the family class when I applied for my landing. do u know of anyone who have been in the situation before and what actions did they take. Help am anxious and nervous

yes, people have excluded their children only to discover that closes the door permanently for future sponsorship - according to the rules.
However, Roy has suggested in the past that there is room for Humanitarian and Compassionate consideration - and that is what you will need. You are also going to need proof that the child is yours and that Mom wants to forfeit the children.
I am sure once Roy reads this he may have some advice for you.
Hope it all works out for you. At 15, your son needs a parent that loves him.

yes, I think the Humanitarian and compassionate grounds would be grately appreciated, I once read that posible this law will be over turn soon so I hope that will for future applicants who makes the same mistake I did.
How do I apply for Humanitarian and commpassionate grounds, I am in the appeal process for my son, do I send them the documents stating my position to do anything to get my son here and they wull consider this humitarion grounds or do I cancel teh appeal and apply for that, how is this process, thsi forum as helped me so much

My child live in Jamaica, it was never my intention to sponser the children without there mother. I have so far sponsered my two older kids at age 19 and 15 to come and live with me.
My intention was to sponser there mom who was my common law partner at the time and she would bring the two other childrem, but we are not together anymore, she wants something dif fro her future than mine and at present she made it point blank it does not include me and canada.
The two other children are 19 and the 15 year old one in question. The 19 year old papers are fine and are in process he will be here soon.
imagine they send the resusal letter to the 15 year old explaining that he is not a member of teh family class, yes he is teh principal applicant but dang he is a child now he is town up and confuse by this letter. One more stress to worry about
