Subject: Skilled Worker application before funds gathered?
  I know that questions have been asked on this before, but the thread was closed before a clear answer was published because it reached 10 replies. Any advice here would bbe much appreciated.

My question regards making a Skilled Worker immigration visa application before the necessary funds have been gathered. I am in a position to pay off my credit card debt by February 05 so as to comply with the "unencumbered" part of the stipulations. At this point however, I will have no money saved. Can I make an application there and then so long as I declare this and can prove I can save more than the required $9,800 within 6 months? Just for the record, I want to do this by the book, and not borrow the money to qualify.

I wish to do this to save some time, especially as there is no clear answer on how long processing times take through the Paris office (their own site suggests 2-3 years, CIC suggests within a year). If anyone has any info on the Paris waiting times too, I´d be very grateful!

Here´s my take:

You must demonstrate that you that you have sufficient funds when you apply. A promise that you will have the funds at some later date is not going to be good enough.

On the other hand, you do not have to be debt free. The funds in your bank account are being used to secure your credit card debt or some other debt, those funds are not emcumbered. So you do not need to pay off your credit card debt before you apply. But you will need to show a sufficient balance of funds in your account as of your application.

Thank you for this info, Grendel, that´s made things clearer in a way! I wasn´t aware that I didn´t need to pay off my credit card debt. I assumed that "unencumbered" meant debt-free, pure and simple. Do you mind me asking how you know this?

Is it really as simple as just providing a bank statement which is provably your money, and not borrowed off a someone? I would have thought that they would take into account any credit card debt you have, as a certain amount of money you have on your savings account is, in a way, not yours if you have credit card debt. And what is stopping someone from using their credit card to top up their savings account to meet the Proof of Funds requirement?

Can I present my bank balance? After that, Does it mean that I cannot manage those funds until I get my PR.

well guys better put all your assets and property in the declaration togerther with its documented current market value, I have already submitted mine and it seems ok, I only have US$3,000+ in bank but my property and business have higher value surpassing the fund requirements for family of four. =)
