Subject: Go to Canada whilst app is being processed?
  Hi there,

I have a skilled worker application and a common-law application being processed in London.

Does anyone know if you are ´allowed´ to go to Canada and wait there til the application has been processed? I do not intend to work, and have saved up enough money to support myself. I will be staying with my common-law canadian partner.

I know that it is the discretion of the officer at the point of entry, which in my case would be TO airport. When I go there, if I am honest and say I am waiting on my application etc - what are my chances of being allowed in?

Thanks in advance to anyone who can offer any advice.

G

That is strange, why do you have two applications going on at once? Is it because if one application fails, you have another option?

I know as far as common law applications go, you can come to Canada as a visitor and remain in Canada until the completion of your application. When your application is ready to be finalised, you will mail/courier your passport back the London office to be stamped.

I don´t know if Skilled Workers whose applications are in process can come to Canada as visitors. Just not sure about that.

do not hold your breath. CIC claims they accept dual intent applications. Their actions speak differently. They will not want to let you in the country if there is any slim chance of your not returning to your home country at the end of your visitors visa. I am still trying to figure out how to provide assurances to have my fiance visit while his application winds its way through the process. we have been turned down 3 times for a visitors visa.

Hi there

I applied as a skilled worker as at the time my partner and I had not been living together for a year, so I didnt qualify for the common-law app. However, the skilled worker app takes forever, and when I finally had been living with my partner for a year, I was advised to submit an application as common-law as it would come through quicker than the skilled worker.

My skilled worker has been in process since July 2004, my common-law went in the beginning of December.

Yes you can. I did it so surely you can. I applied for skilled worker in February of last year and visited Canada as a tourist in September. I did have to get an interview as I was not from a visa waived country but I had to prove I was not going to stay in Canada and was surely going to come back. It is not like the US where a tourist can not have dual intent. It seems in Canada you can.
